I filed for bankruptcy 24th July I am totally up to date with rent payments and am a good tenant.I checked my tenancy agreement and it doesnt say i am breaching the agreement by filing bankruptcy infact it doesnt mention anything at all about bankruptcy but now the the letting agent have started to call my phone i havent answered because im worried about what they are going to say!!

First of all, the filing of a bankruptcy petition automatically halts any and all legal actions to collect a debt. To go ahead with such a legal action, the creditor must request, and obtain, the permission of the bankruptcy judge.

Secondly, in spite of what the lease might say about bankruptcy being a violation of the lease, it's very unlikely that a judge will grant an eviction if the tenant is up-to-date in the rent.

Third, once your lease expires, the landlord can refuse to renew it and can give you a notice to vacate, whether you are up-to-date in rent or not. This also applies to month-to-month leases. The landlord must give a proper notice terminating the lease.

I'm assuming you're in the USA; I'm referring to USA laws.

I forgot to check if you are in the USA but IF so they can not evict you as long as you are current on the rent and have a lease that covers more than month to month. IF month to month the can give you written notice, usually 30 days, and then you must move.

With month to month, if that is what you have, either of your has the right to give notice and move on.

If they were going to evict you, not answering your phone is not going to stop them from doing it. They would have someone serve you with eviction papers so I really doubt that is what the call is about. Just answer your phone that way you don't have to sit up all night worrying about it asking people on YA.

is your mode of payment now controlled? ie. your chequing account on an allowance due to the bankruptcy.

They could be getting shorted on the payments, and it not be totally your fault.

How would they even know? Was your rent accidentally included in the bankruptcty? Answer the phone.

There should be no complications, if you have remained up to date with your rent.
