If a security guard catches you having sex in an empty shopping mall parking lot, and he decides to press charges, I imagine that the charge would be "indecent exposure".
What is the punishment for indecent exposure? Jail time, a fine, community service, counseling, a warning, or probation?
Thanks for your answers!

Indecent Exposure, Lewd/Indecent Behavior in Public, Some Comunities have Local Laws.
As a Note, A Rent-a-Cop is Not a Police Officer, and Can't Arrest you for it. Best he/she can do is Call the Police, and Tell you to Move Along, as it IS Private Property. Most of these Offences are Summery Offences(Like a Ticket), and an Officer needs to Observe the Violation to Ticket for it. Summery Offences are usually a Fine or C.S. time. A lot of Security works on "Citizen's Arrest" which only Applies to a Misdemeanor or Greater Offence-Attempts to Keep someone there who Wishes to Leave Peaceable are covered under Kidnapping/Unlawful Resraint.
If it's a Misdemeanor in your Community, a Police Officer could Arrest you, and there Could be Jail Time.
Best Advice is to Quickly Move-Along, and Not go Back there.

Security Guards do not have proper jursdiction to arrest you. They do not work for the state and thus cannot arrest/charge you with a crime. They would have to call a police officer to arrest you.
The punishments could be up to two weeks in jail, I believe no more than 1k fine, community service will be based upon the DA, counseling would only happen if you were caught doing it more than once, a warning is more than likely, I don't think you would get probation.

It would be a misd at best. Security Guards can only make a citizen's arrest and file a complaint. Your local police officer would most likely give you a cite unless either kids or people were present. Seems most of the time a person would be let off with a warning.

depending on the size of the car, a few sore muscles and/or bruises and a bill to have the upholstery cleaned.
But seriously though, if it's your first offense, you'll get away with a slap on the wrist, probably a small fine and a warning.

A warning. Next time, a misdemeanor for indecent exposure.

Depends on which state you live in. In Nevada, he can summon the police and you will be arrested for gross and open lewdness, which is a gross misdemeanor bringing up to six months in jail.

Last time I had sex in a car I threw my back out....That was punishment enough.......When the Judge wipes the smile off his face he will probably give you a conditional discharge.
