record. He has been to court on it and has been found not guilty but the recruiter says he still cannot enter into the service. Has anyone heard of this before and if so how does he resolve it?

The charges were gun and drug related... But the courts found out that someone else was responsible.

Yes, I have heard of this. My brother-in-law was trying to get in the Naval Reserves after getting out of the Navy. One night his cousins and he were arrested for robbing this waitress after this bar closed. He was arrested and went to jail, but they found out that the waitress had set them up and stole the money herself. He had to get an attorney to get the charge removed from his record. He didn't even know it was on there since he was charged but the charges were dismissed. After having his record cleared or expunged of the charges, he was able to join the Naval Reserves.

I used to work for a local police department and the local recruiters used to come into the department all of the time to check on criminal records. If he was charged with something and then found not guilty, then the charge was not taken into consideration. The only time I saw the recruiters take pause was because it was a drug related offense or a serious assaultive charge. I would have my friend talk with the recruiter again and find out exactly what on his criminal record was causing the problem. Ask if expunging (removing) the charge from his record would help.

My husband had been arrested for a few things in his past but he was also a minor at that time not sure if your friend was or not.My husband is in the military now though and has been for 10 years.He had to get some sort of a waiver to be able to enlist.If he was a adult at the time he may not be able to get in.If he was a minor and it was nothing major then there shouldnt be a problem.My brother in law has ran into the same issue though he is a adult and has a record and also cannot join.

just because the courts found him not Guilty doesn't mean the Military will waive the charge, especially a drug or gun related one.

as far as the military is concerned, being charged is enough.

Try a different recruiter. Even though it is on his record, it was still a Not guilty. He can have his record expunged, meaning taking off , since he was found not guilty. Tell him to check with his attorney, who can file the paperwork to get this done.

go to a different recruiter. this guy is pulling his chain. the military will accept him as long as there is no conviction. i know people who are in the military with drug charges on their records... and it also depends on what mos he chooses. remember "no charge no problem" he can still get in.

Depends on the criminal charge...the military is very desperate they will take almost anyone, but if the person has committed a crime (or at least been charged with one), it all depends on the nature of the crime for which he was charged.

Guns and drugs -- never get in the military service. May be he can get a job in Iraq and a soldier of fortune or mercenary
