If i applied for the m/c would they be able to put the charge off balance on that card or is it off thier books?

If 7 years have gone by, you are free and clear. But I don't understand, if the charges were not yours, why didn't you dispute them back then? They would have taken them out of your credit report Also, why don't you just get a credit card from someone else.

Actually, read the cardmember agreement... they CAN... they have been guilty of doing this to people before.

It's 7 years for the credit report, but you still owe them the money.... and they can still attempt to collect.

Cap 1 is a very sleazy credit card company. You should avoid them. If they held you responsible for unauthorized charges, you already know they are sleazy... why deal with them again?

Capital One has long ago charged off and sold that old debt. Go ahead and apply for another card if you want.

You can contact them and see if they still have it on their record -- b/c if they do it may pop up on your credit report again. But if not, don't worry about it. If its been 7yrs and its dropped off... it wont affect your credit anymore (especially if they have completely written it off as bad debt). I would just make ABSOLUTE sure that the debt really has been written off for good.
