Can you be arrested by a police officer (on public or private property) by telling the officer you are currently under the influence of a controlled substance (and not possessing any of it)? And specifically, in Arizona.

This is just a guess. If you are NOT under the influence, you have given a false statement to a police officer. If you ARE under the influence, you have confessed to a crime. You can't be under the influence unless you had the substance in your possession. I could argue that you STILL have enough in your possession, specifically your bloodstream, to be under the influence.

If you're out in the street they could arrest you under the public intoxication laws. I never heard of anybody being arrested for anything other than possession or distribution if they're on private property, though. And on a practical level, cops generally don't arrest people for intoxication unless they're also driving a car or behaving in a disorderly manner.

In many states now, officers can have blood tests ordered to show you are under the influence which results in a possession charge. So yes. And admitting to is just the icing in the cake!

controlled substance means illegal so yes.

You have three potential charges:
1) being under the influence of a controlled substance
2) wasting an officer's time (if later say you lied)
3) Stupidity ... lol

Well, at the very least you would be arrested for being an 'idiot in a public place'. You would likely be taken to a detox center as you sure as hel* are too stupid to care for yourself.

As long as you are of age it is not a crime to have illegal drugs or alcohol in your system. It is a crime to possess, use, buy, or sell illegal drugs.
