he has not payed a dime to me for 5 weeks and he has thretend my girlfriend boddely harm,

I know someone who was in that situation on a property far from where he lived. He had a local real estate agent who had done the original rental. She had her cousin who was a burly deputy sheriff come pound on the door of the tenant and explain that he was "evicted" and had till the next day to be safely out of there. That worked very well.

There are three situations I can think of where it's possible to get the local sheriff to immediately evict an occupant without needing a court order.

1) He's not the legal occupant (i.e. the person you rented the property to moved out and allowed somebody else to live there in his place). Mind you, if you ever did accept a single penny from the new occupant, then he has acquired full legal status as a tenant and you must go to court first.

2) He never paid any rent (i.e. you allow a relative or a guest to stay on your property for a while for free and he then decides to squat there). If there has never been any exchange of money with the person, then there is no landlord-tenant relationship.

3) He's a roommate. Tenants normally have all kinds of legal rights against you forcing them out of their home yourself, but they only apply if they have their own separate apartment. When you are sharing your own living space with somebody where he has access to all your personal belongings, you are legally king of your castle and can kick him out at will.

roommate? If he is in the lease?
If he is not in the lease give him a writing notice=eviction to that person to move out and if that person is not in the lease you have the right to call the police to put him out.
But if is in the lease then you do have to go to through the legal system just like another cases.

Legally.....none to my knowledge.

If the guy threatened your girlfriend, he committed assault. This is a crime in most states. Pursue the law enforcement route and have the guy thrown in jail for a few days to cool his jets. In the mean time, move his suff out and change the locks.

Serve him with an eviction notice. Your local sheriff's office will have all of the info you need on that. Try their website if they have one.

You will only need to go to court if you're seeking damages or back rent. If you just want them gone, then serve them.

Ask them to leave the apartment but do it in writing and have them sign a copy . You give them 3 months to moved out , if not then you take them to court.
BUT if they moved out without paying rent then you will have to go to court anyway to get you money.

That depends on the state in which you live.
In our state, that would be a big no. I can kick a tenant out for any reason. (I usually let them get a month late before I start pounding on doors.)
