When there was a draft, the 'sole surviving son' could get an indefinite deferral. If his older brother returned though, his number could come up.
It was in the Selective Service Act prior to 1973. Deferrals were also available to students, defense workers, or if you were the sole support of a parent, child, or invalid.

The rule was that if you were the sole child of the family, you would most likely not be drafted. However the draft is not in effect anylonger so that doesn't apply anymore. The military is fully a volunteer military.

It was called the Sullivan Act. "There is no such act or law. However, after the Sullivan brothers were killed, there were several bills introduced in Congress that related to family members serving in a military unit together. None of these bills were enacted into law. However, there are military policies and directives to discourage immediate family members from serving together."

If we are still in Iraq after 2008 and they reinstate the draft, you will see congress fight over the stipulations into the process. I belive the odds are true in your statement. The modified requirements came after the outcry over the death of the x5 Sullivan brothers in world war II.
