Can you go to jail for two years ago claiming someone elses kid on your taxes and you don't remember their name and now that person is being asked did you claim anyone for that year. The kid's aunt wanted my friend to claim the kid on his taxes and give her the money. Now he is screwed cuz he can't remember the kids name it was in another state and if it shows up that he did claim this kid on his taxes and he is saying he didn't wow would that be fraud?

What is the likeliness that they would catch up with my friend? I mean its been two years how long would it take for that to happen?

no they didn't ask him about it but they were asking if he filed for 2005 and if he claimed anyone and he said no but then they put him on hold and he hung up real quick like like Oh crap I did do that but forgot the kids name. I was like whoa dude thats crazy! Yeah he is in a pickle and worried about it now

He wouldn't be likely to go to jail for it, but would have to pay back whatever he saved in taxes, plus interest and penalties, and probably plus fines.

It's hard to say whether or not the IRS will catch it two years later. They've been looking closely at claims for dependents recently. If the person is being asked questions about it by the IRS about their claims for the year, then that would say that the IRS has already caught it, so he can expect to be paying a lot of money although probably not going to jail.

I do not think that not remembering a child's name is against the law.

If he claimed a child that he knew was not his child to claim, then he could go to jail for that, even if he remembered the name.

The better question is why doesn't he just look at his old return and see what the kid's name was??? Duh.

That's a felony punishable by up to 10 years in prison and $10,000 fine and he'll have to pay the money back with interest. But they usually don't push it that far. If he's really lucky he might get away with just paying the money back with interest.

Yes, it is tax fraud and they may have to pay a hefty penalty and could possibly go to jail.
