my 14 yo son and two friends were charged with criminal possession of stolen property, one of the boys took mannequin pieces that were in someones yard laying against a dumpster( the owner verified that she had laid them by the dumpster) the boys then took the pieces two legs and a torso ( not even a whole mannequin) over to another friends house where they dressed the pieces and brought them to various friends houses, the police took 2 months to investigate the missing mannequin pieces. the boys believed these were garbage and they all told the police this in their statements, but they have been charged with criminal possession of stolen property , and they have to go to court next week, does anyone know what kind of sentence they can get? Do we need to get a lawyer?

They are children. They are not going to jail. If you cannot afford a lawyer, ask for one. A lot depends on the state you are in, but no state is going to prosecute these boys as adults. I suspect, community service, some restitution and short period of probation. Don't panic, but don't go alone.

if it is what they say, than you have nothing to worry about...property is considered trash (public), when placed on the curb for pickup or next to a dumpster as you indicated...the previous owner no longer has rights to the property, and therefor may not "charge" someone with theft (possession of stolen property)...UNLESS of course if the person the boys "acquired" the mannequins from had stolen the mannequins THEMSELVES, a charge for possessing the stolen property may stick regardless of intent...but at 14yo, I highly doubt it...just explain it all to the Judge, you shouldn't need a Lawyer for that..!!

Sounds rather odd. If it were on the curb like that, it shouldn't be pursued as a theft. Only thing that would make since they would be if the person who dumped it had stolen it and they came along and picked it up. Definitely get a lawyer on this one.

they could get prohbation and/or fine... if they have a clean record they will most likely get that. being that they were on someones YARD when they took the item, it is not considered garbage... the worse thing that could happen is that they can get up to a year in jail the most..
