In California, during the first year of your license, if you are in a accident with a passenger under the age of 25 (not permitted by law) is the accident automatically your fault even if the accident was obviously caused by the other person? Like if you got rear ended?

No, you're not automatically at fault, although you may be ticketed for violating the terms of your license (for having a passenger younger than 25). I assume you have a provisional license.

The accident would not "automatically" be your fault. You may get a ticket if you are violating the terms of your license though.

If you get rear ended it is not automatically that persons fault yes it was years ago but the ins. industry has a neat term called contributory negilance and after investigation you will be assigned a portion or percentage of fault. so before you go slamming on your brakes for kicks think about the above

You're ALSO not automatically at fault, just because your plates are expired, or you don't have your license on you, or you're not wearing your seat belt.
