I went through some bad times, and during that time I wrote a check to a friend which nsf. He says hes gone to the police. Things are going better for me now and I can make payments. If i make payments can I still be charged for fraud?

Normally a check that bounces for NSF is not considered fraud.
Unless you knowingly write a check when you know there are no funds( This can be hard for the prosecution to prove) or the account has been closed.

Contact your friend and inform him of your intent to repay the check. Your friend may also be entitled to damages as your state allows.

Sorry to hear you have been down on your luck but it's great to hear that thing are getting better. The thing to remember is everyone makes mistakes and you are given ample opportunity to rectify these types of errors. So, don't worry too much about it.

just happened to me, i wrote a bad check, not intentionally, at a grocery store. It went to the District Attorney and I paid the check plus fees.No you don;t get arrested unless u forged a check. If you don't pay it u don't go to jail unless it is a fraudulent account (like someone elses) you may have to go to a one day class on financial responsibility. Just go to the friend and pay him, or you mey lose a friend, even if it is small amount. Put yourself in his shoes, he trusted you.

You aren't charged with fraud - you'd be charged with writing worthless checks. If it was an individual, yes, he can drop the charges if you work out a payment plan with him. All he really wants is his money, so I would think he would.

Payments might stop those who suffered damage from filing the case against you. There is technically fraud, payments are the proper defenses.

If your "friend" borrowed money from you knowing that you yourself were facing hard times, you need better friends. When the check bounced your friend should have just let you know and not get you in trouble. I'd get a lawyer. You were trying to help out a friend, you didn't rob a bank.
