I live in Califnornia. My boyfriend was driving my car, and has a suspended lisence. My insurance has lapsed, and I haven't gotten new insurance yet. Today he was in an accident, him and the driver exchanged info, etc.

I'm wondering if the insurance company for the lady he hit is going to go after him or go after me for the damages - because I am the registered owner. My boyfriend tells me that they will go after him because he was driving, but my parents have told me that they will go after me because the vehicle is mine - my name, my car, my responsibility, etc.

I am confused by it all, and would just like to know what's going to happen!

First off - it's a simple question. You don't have to be rude. Second - insurance lapsed a little over a week ago. I am a full time student and I work fulltime - there are only 24 hours in the day. So the rude comments don't need to happen.

It looks really bad for you (and your boyfriend). Are you absolutely *sure* your insurance has lapsed? I'm really hoping that you are mistaken about that. My insurance company sends me new certificates of insurance when my policy is up for renewal and once I forgot to put the current one in my glove box for a week or two (fortunately, nothing happened in the mean time). In any case I'd call the insurance company to find out if there is any payment grace period. Probably not, but miracles do happen.

BTW, in the future, be sure to have your insurance payment automatically deducted from your checking account so that it cannot go unpaid. There are very few things important enough to turn over your banking information, but auto and health insurance are two of them.

Unfortunately they can come after both of you...

you are responsable for

#1) making sure as the owner that your vehicle insurance is paid up...( I pay mine 2 days to a week before due direct at agents office)

#2) you are responsible that only licensed drivers have acess to your car or its keys at any possible time... period

and

#3) it doesn't mean he's off the hook either if he doesn't take care of the other persons damages he could end up in jail

but they still could come after you...

and if your insurance finds out about this they might cancel/not renew your insurance too

As the registered owner of a vehicle in a state where insurance coverage is mandatory, you are responsible for anything that happens to your vehicle unless it is stolen. So they will be coming after you. Once they have taken everything you have, then they might go after him as the driver of the vehicle, but you are their primary target. If your insurance lapsed for non-payment, and the insurance company notified the state of that fact, you may also have a revoked license.

But your parents are very right when they say "Your name, your car, your responsibility."

If you knew you had no insurance, and knew he didn't have a license, what ever possessed you to give him the keys?

To start with the other ladies insurance will probably fix her car and they will come after you AND your boyfriend, your car and you are responsible for who drives it, you could always try using the dumb and stupid card and say that he told you he had a valid License and you never had any reason to think otherwise,, but if that doesnt work get ready to bend over and take it in the shorts, Now Im sure the police were called and any citations issued ? OR you could be really nasty and say that he stole your car without you knowing it,

"There are only 24 hours a day"- well gee... god forbid you take 1 minute of that 24 hours and be a responsible person. What if you had hit a school bus? What if your boyfriend killed someone and his family had no money for funeral expenses because of your selfishness? What if a family who was struggling and barely making ends meet was struck by him and were in financial ruin?

Let me start by saying you deserve every cent they take from you.

You are going to be responsible for all damages to the other vehicle, their rental while they have repairs, and if any of them are injured.. well.. thats a whole other ball game... that could go into tens of thousands of dollars.

If you dont have the money... well... look forward to being poor your whole life b/c they will garnish your wages and you will face legal consequences.

In my state they will go after the driver if there is no insurance. You not having insurance is going to have repercussions and you will likely have fines and court. As he was using the car with your permission you can be pulled into the case if he can't pay for everything.

Well the way I look at it is if he was driving your car and got pulled over for speeding, would the ticket go to you??? Make him pay for it, it also depends on what kind of insurance you have, i know with mine it covers people who drive my car. Which means that it would be the owners responsibility for the car and damages it causes. I would keep real quiet about it and make your bf pay for the charges and don't tell him crap about you having to pay for anything. If he was a decent guy he would of told you that right away that he was going to take care of it.

Your liability, (he's on the hook too), in a civil suit.

What's gonna happen?
Heres a guess:
"the lady" makes a claim thru her Ins. Co.
They Contact your (past), Ins. Co.
- and out you have no coverage.
They're looking for the money.
They will come to you first,
(you,ve got the only asset in sight, your car).

Oh, BTW. Your boyfriend may wind up with a warrant on him.

Sorry, but you have to expect rude comments when you act irresponsibly. It goes with the territory. You are BOTH likely to be sued. He was driving with a suspended licence, against the law, he was driving an uninsured vehicle, against the law, and you allowed an unlicenced driver to drive your uninsured vehicle, against the law.
