I recently purchased a truck two weeks ago and was just in an accident a few days ago which I'm not at fault for. The truck cannot be considered totalled but basically I want a new truck because of the damage and the fact that it's new. I also just recently found out that the dealership broke the contract they made with me. If they broke the contract can I return the truck, or trade it in for equal value even though it was just in an accident but they broke the contract?

Contract being they said they would give me 15000 for the loan, and they only gave 14900. 15000 is in the contract but thats not what they paid out.

Are you saying that you signed a contract once, and the dealer said that a new contract had to be signed with different terms? That is not breaking a contract. You obviously signed it prior to the accident, so it does not matter anyway. Unfortunately, you now own a truck that has been in a wreck, and is worth less money. The truck already took a depreciation hit the second you drove off the lot, but now it is more. You can attempt to trade the truck, and ask the other guys insurance company to pay you the depreciated value due to the accident. You will need something in writing from the dealer stating the loss of value. Otherwise, if the repair is to your satisfaction, you can always keep the truck until you are in a better trading position.

The short answer is NO. If your car is outside of the building, it is not in the control of the Repair Center, there for not covered for damage or theft. When you leave a car at the shop for repairs you must ask for it to be left inside the building for it to be covered. This also has to be agreed on by the shop owner. The problem is there is very limited room in a shop, and also the room that is available is space for making repairs. If the car isn't being worked on while its inside, the space isn't making the shop owner any money. There for the shop owner will most likely want to charge you for the use of the space if you want to keep it inside. Most shop owners are willing to help you out in some way just to retain you as a good customer. But keep in mind that they don't have to. So please try and be understanding when asking them what you should do and if they can help you in some way. Remember: A small gesture of kindness can go along ways in building a good relationship. But this goes both ways. So try and be as kind as you can when you ask. If the shop owner is rude and won't help you out at all. Then you already know this is not a good place to do business with in the future. If you tell three people about your experience and they tell three of their friends it won't take long until the whole area knows about it. And this is what shop owners should fear the most. You may want a new truck, but you aren't entitled to a new truck. It wasn't a new truck when you were in the collision. Insurance only pays for the fair market value, they aren't going to buy you a new truck.

How did the dealership break the contract? A party in a contract can't unilaterally break it.

You got in an accident and then found out the dealer broke the contract.How did they break the contract,you better check with a lawyer before you say they broke a contract,you could get counter sued for slander.

Unfortunatly for you, contracts are normally for the benefit of the business not the consumer. They are iron clad in keeping you in line, but they are full of loop holes for the business. Just look at an apartment lease for a great example!

If the reck was not your fault, then go after the person who is at fault. That fight will be alot easier and less costly to you.

It's not the dealerships fault that you went out and got in an accident. They are not going to give you a new truck for a dinged up one. Geesh.

I highly doubt it.

Even if it were possible, the amount of money you would have to pay to sue would be more than what the truck was worth.

In what way did they break the contract?
