further to this if you admitted liabilty and any damage as been caused to either car your insurance company may not pay you out if you have a fully comp. because the insurance company tell you never to admit liabilty even if you are they could refuse to pay for the damage to your car. just to clarify they MAY REFUSE I have not said they would

Prosecute for due care and attention.. or ask you what happened and ask your cousin and then other witnesses who were behind the person you crashed into. They can't force you to confess, say as much or as little as you want. If you get the option go to the police station for the interview. They are unlikely to arrest you, but you would be entitled to free legal advice while at the station because you are being interviewed...
Then the evidence is evaluated and a decision made whether to prosecute or not.
If they all say your light was red and the other guy's was green you don't have a hope. Plead guilty take the points and fine. If they offer you the ticket it is likely to be a better out come than court, at court it will be at least £60 and 3 points.
If it is one word against another it is likely to be settled by insurance companies so long as no one was seriously injured.

Regrettably you should have let the other vehicle rear end you. Had you stopped & he didn't he would have been liable.
If your lights were in the process of changing then the car you hit must have gone through a red light. It was a mistake to admit liability that is for the insurers & police to decide.
If the police are trying to make you confess it sounds like they have no actual witnesses, so long as you are sure it is truestick with the lights changed to amber as I approached and I was too close to stop safely what ever you do do not say I was going too fast to stop that leave you wide open to a speeding fine too.. Did you get the details from the guy who was tail gateing you? If you did and he says it changed as you went through it you are in the clear. If not I'm afraid your going to have to hope all you get is a fine and 3 points you could get driving with out due care speeding and reckless as well.

Amber usually means"Stop if it is safe to do so". Obviously if a guy was tailgating you,to do so would have caused a rear ender.
The guy that you hit, or hit you, must have been pretty quick off the mark,ie probably set off on the amber, instead of waiting for green.
Where was your car damaged? Front or side.If front,it would suggest that you were late crossing the lights and hit the other guy in his side.
If you were hit in the side,it would suggest that you were acting as you said, to prevent a rear ender and the other guy jumped the lights.
Unfortunately your cousins evidence will be invalid as he was in your car and related to you, and could support your evidence through loyalty.
The fact that you admitted the accident will not go down well with your insurance, never admit liability.
Sit down and gather your thoughts, tell the truth. The police will have a good idea who was at fault by analysing the accident damage.

If you collided with another vehicle straight after you went through the red light, it means the other vehicle jumped the gun as the lights the other way do not turn instantly to green, there's always a delay to allow the junction to clear.
The law says that if it would be unsafe for you to stop then you are in the right to drive through an amber light, but the fact that you hit another vehicle makes me thing that you may be being ecomomical with the truth.
Usually, if insurance sorts something like this out to everyone's satisfaction, the police don't bother getting involved unless someone is injured, but if they do decide to charge you I think you may be in trouble. Your cousin is not an impartial witness, so his testimony won't count as highly as if it had come from a bystander.
60 pounds and 3 points is hardly the end of the world. I would count yourself lucky to get off with that.

Do you remember reading the Highway Code? Red means stop, Amber means stop, Green means go if it's safe to do so.
As you've already admitted fault, there's little you can do, you ran the junction against the lights. You'll have a job citing the "car behind you" in your defence, what evidence do you have?
Your cousin will not be considered an independant witness.

Firstly, if ever involved in an accident DON'T admit any blame. If you ran a red there is a recourse in law that allows you to do this to prevent an accident, ie: going too fast(within the speed limit) to stop in a safe manner. Also, what proof is there (other than the word of the person that hit you) that you did run the red? Any photos, witnesses?

That amber light meant stop unless it was unsafe to stop, you crashed so it was obviously safer to stop. most people here seem to agree you should of stopped. If you go in-front of a judge He may of seen cases just like this where people have been injured or killed and have no pity on you, like the guy above who amongst other things said he would make you resit your test. I do not believe you but I do not know the hole storey only you know the truth. if you know you are innocent then stick to your guns but know there are many innocent people in prison, so consider seriously about paying the £60 fine with 3point and with some luck its over. innocent or guilty that's a very small price to pay, as I said their are many innocent people in prison. Being innocent does NOT equal being found NOT guilty

Sorry, but you are bang to rights, amber is a warning signal and you should have stopped, the car behind you could have run into you but that would have been their fault, and YOU wouldn't be liable for the penalty points for running a red.
Lesson - amber means do not speed up to get through the lights it means stop!

Well you've already admitted it to your insurance company, if it goes to court they can call the other driver as a witness (should you plead not guilty) as it is, you've explained quite well here what happened, so to say now you were not at fault is patently untrue. You were wrong. Plead guilty pay the fine, which may be more than £60 and just accept you're getting at least three points. They may decide on due care charges as well.
