When I entered store parking lot - Big Company Truck Trailer was leaving parking lot – was already partially on the street – when I turned behind to get to the wood scrap. Then driver started to back/reverse – apparently he misjudged the turning radius. To me it was quite a shock to see this monster trailer backing to my side. I was pulling horn, screaming – he did not see me – did not hear me and hit me – dented the side of the truck ($2600 repair estimate). Only way for me to get out was to back up – more in fear and panic, than rational thinking - save myself - I backed up to the side of parked truck (third truck Chevy) causing ($1600 repair estimate damage). Damage to the rear of my truck (F150) was minimal and is not included. The Big Company Truck insurance is trying to minimize payment to my truck and does not want to cover the third truck at all. Would I have a case in the small court to ask the Big Company Truck insurance to pay for all the damage caused?

if you were hit from that big truck, of course that truck will pay for you. but in trying to escape or kinda panic, you hit another car which means "you" will be the one to pay the damage of this car this time.
*if only you were hit and was connected to another car without you trying to escape, then the truck will pay both of you and the next car.
>>this happened to my friend when she was hit from a car in front of her who is doing a reverse/back without looking if someone is at his back also. so she was hit and her car hit another car at her back also. in this case, the first car who hit her had paid all of them the damages incurred.

Get your insurance company involved. They have attorneys on staff to handle these things. There are a lot of variables to consider. If your version is correct and you were trying to avoid a collision or further damage and injury because of the BCT driver's negligence or incompetence, then yes, I agree the BCT insurance should repair both vehicles. The questions not answered are :" Who was cited?"and, "Did you have insurance at the time of the incident?" If you were not insured at the time, you are at fault because you should not have been operating a vehicle at that time and your presence in the parking lot is a mitigating factor in the damage to the third truck.

The trucking company's insurance should pay for your damage. In your efforts to escape, you caused damage to a third vehicle, which your insurance company is responsible to pay. Two separate collisions occured.

Sorry- you cant cause one accident to avoid another. No way will that guys insurance pay for all the damages. Turn this into your carrier. They will fight for you but likely pay the parked vehicles damages.

in this case you are at fault because the truck didnt push you into the vehicle behind you. you backed into him

You need to have your adjuster handle the claim. But, from your description, he hit you, his fault, you hit the parked truck, your fault.
