our local shop keeper reckons that jaffa cakes are subject to a government conspiricy. He says by calling them cakes they are not subject to the same VAT as biscuits.
What do you think?

I think that your shopkeeper is deliberately relaying false information to you in the hope that the "great Jaffa Cake rumour" will erode your confidence in our government,thereby turning you into a cakey-biscuit terrorist who stalks the night.

It's the other way around.

The makers are claiming it is a cake to avoid paying VAT and the government took McVities to court claiming it is a biscuit. To prove the case, McVities actually made a full size Jaffa Cake to prove the point and won the case.

It is entirely true that by calling them cakes, they are subject to lower taxation, though it is by no means any kind of conspiracy, just a loophole of sorts. Though i think the European courts were tying to get them to change the name from 'cakes' even though they clearly share more characteristics with a cake, than a biscuit.

yeah but the real question here is... is it a cake or a biscuit?
cause i cant bloody tell, tastes like a cake but looks like a biscuit, huh, doh..... just trying to figure that one out makes me feel like homer simpson! lol

but on a more serious note..... can i call my car a bike and get away with cheaper tax and insurance then? if so .... woo hoo

i am puzzled ( which is not unusual ) but why would the government any government not want to charge vat on Jaffa cakes

Interesting question... That may be a loophole for stuff from Entemens or a commercially wrapoped and bought product, but I think a local baker can call his wares whatever he wants without fear that the FDA is going to be monitoring him.
