It's risky, for as soon as you attempt to post notice of Intention to Marry, the Authorities will request his documents. The only way to do it is for him to return to his native country and for you to marry him there. Make sure you have plenty of evidence to prove that you have been in long relationship as you will need to prove to the US Embassy that you have known each other for a period of time, usually at least two years. You can then apply for an entry visa for him, as your spouse. However, be careful as there is a high possibility that he may just be using you to become legal in the US. If that's the case, he will dump you and divorce you as soon as he gets US Residency. Before thinking of the options, think seriously! How long have you actually known him? What do you know about him? Who suggested getting married? Has he put any sort of pressure on you, such as you "need to marry soon or you'll lose him" or he'll get deported if you don't marry him" etc? Before going ahead with any plans, make sure that you are 100% positive that he is being honest with you. Good Luck!

Since he came in legally,you both can get married and adjust his status, like the gentleman with the list of forms you would need to submit after wards said. Once he is married to you, CIS can pardon him for working illegally, and adjust his status. If he is clean-cut (no jail, fines, tickets) and of good moral character they will probably not even question that he over extended his visa.
A close friend had the same situation and she adjusted her status w/ no problem

Yes, he could be deported. They are enacting stricter and stricter laws regarding this, as well they should. This is all his own fault; he should have left when he was supposed to or applied for citizenship while he still could legally. I have no sympathy for you, no offense. People like you who marry illegals are just making everything worse. I understand you love him and that's not something to be taken lightly. But if he loved you, he would go about the proper channels to gain citizenship and not risk losing you. Just my opinion.

legal status with immigration is something else ,
but the marriage may highlight the illegality to the authorities and they will have to act .
why not go back to his country and marry him there .
then you can come back and apply for his legality ,
But you will be closely examined to determine the authenticity of your relationship.

MARRY HIM! Marrying him and filling out the proper paperwork will make him legal. Probably the easiest way is for him to go to his country and for you to fill out the paperwork for a K1 visa.
