If stopped be polite and cooperative remember peace officers are people too. You have a family well so do they.

Assaulting a peace officer is a very serious offense. I don't know about the police officer not pressing charges I don't believe that ever happens. Face the facts many police to civilian transactions are video taped and and verbally recorded.

Assaulting a police officer may get you sprayed with pepper spray if necessary. Don't even think about doing it.

If you attack a police officer while they are on duty, you probably will not get to say why you were attacking the peace officer (as it seems like it is related to off-duty activities).

While it is up to the police officer if he reports the assault, he is not the one who presses charges. Charges are pursued by the district or city attorney. Most district and city attorneys take assault on law enforcement officers very seriously and jail time is likely.

the answer to the question you've asked is "No." If you are in jail but no charges are filed within statutory guidelines, you will have to be released from custody. You are constitutionally entitled to an initial appearance within 48 hours (excluding non-court days).

Attacking a cop is a bad idea. They are smart enough to kill you while making it look legal, especially if there are no witnesses around.

Hell in Chicago we just had a cop peg some guy in the back, don't give the police cause to harm you!

Yes, the state can prosecute you for any crime even if the victim does not. Normally due to costs they try to only prosecute the most serious offenses such as child abuse/ neglect, murder, and drug trafficking. In any situation you should not result to violence unless it is in defense of yourself or another who can not defend themselves. In the situation you described it would not be permissible for you to assault anyone.

The police officer would be the victim and if he does not pursue charges then you would be released from jail. I'm not sure why he would not pursue charges though.
