I was involved in a 3 car collision, I was the car in the middle. I was hit first from the back and due to the impact my vehicle skid and hit the vehicle on my right lane as i turned my steering when i was hit being scared of the fact that i may injure my face. Now i am not at fault as per the police report, as i was hit first. But the insurance company of the guy who hit me is taking a really long time to investigate this and trying to make me the culprit in the situation. So did i do anything wrong by turning the stering to my right when i was hit. Am i responsible for damages to the front of my car? The traffic was heavy and i was about 3/4 th car distance away from the car in front of me. Any ideas about this issue?

Well, here's the thing. Is the guy who was behind you totally at fault for the entire accident?

Depends on what the people in the first car say (which may be why the investigation is taking so long).

Why?

If you were truly hit from behind and pushed into the vehicle in front of you (regardless of whether you turned your wheel or not) - then the car in FRONT of you would only have felt ONE impact.

If the people in the front car said that they felt TWO impacts? That implies that you hit them first and then the guy behind you pushed you into them again.

I know it sounds contrite but the insurance company of the guy in back does not want to have to pay for damages they don't owe. They want to make sure they only pay what they owe.

Makes sense, right.

Not sure how they are trying to make you the culprit. If that is really what they are trying to do - then there is something you left out because there are reasons that you could be found partially at fault for a rear end accident.

Simply turning your wheel to the right is not one of those things.

If you are in a hurry to get your damages fixed - I would recommend going through your own insurance company (if you have first party collision coverage) and letting them worry about sorting out the liablity issues and collecting from the other guy's insurance company.

Eh - also, depending on what state you live in - if they haven't made a decision within 10 days - they have to keep you notified of status and what the delays are. Ask for correspondence and keep a record of everything.

The driver who hit you is totally responsible for the entire accident. Deal with your own insurance company ONLY and let them sort it all out. Do NOT have ANY direct dealings with the other 2 insurance companies. If they contact you, refer them to your insurance company and do NOT make ANY statements of ANY kind to anyone but your own insurance company.

What the police report says means little unless the police did a formal investigation. Normally they don't do that unless there is a fatality, serious injuries, or major property damage involved. Let the insurance companies fight it out, that's one of the reasons that you buy insurance in the first place. Your insurance company has an obligation to defend you against any and all claims, rightful or frivolous. Let them handle it.

Unfortunately that guys insurance company owes him a complete and through investigation- he pays them to insure and protect him afterall. This isnt a "gimmick"- i love how people think insurance companies are out to get them.. its just an investigation.

It may be that they are still attempting to contact the front car to see if you rearended him first. Maybe he isnt cooperating so thats taking time. Investigations are based solely on the police reports. THat officer did not witness the accident- how does he know what happened?

Again- they owe their insured a full investigation. If hes saying you rearended that guy first.. they will investigate that. This arent trying to "Trick you"- the world isnt out to get you... they just have to do what they have to do. If you dont like it- go through your insurance.

There is a requirement regarding the length of space you are supposed to have in front of you based on the speed you were traveling. The guy behind you may have been at fault compared to you, but compared to the person ahead of you there is still an open question as to whether you also share fault. -- To Heavenly Bliss, the question arises when the person behind her doesn't HAVE insurance...

Don't let them get away with putting the blame on you. It is definitely the other guys' fault, since he hit you. You cannot control where the car will end up once hit. Fight it to the end. You are not at fault.

Well, if you rear end someone you are always considered "at fault" regardless of what the other person did. (stupid I know) That doesn't mean you'll receive a citation, but the insurance company will consider you at fault.
