I slipped on the floor in a local Wal Mart store last week. One of their employees had been mopping and failed to put up one of those "wet floor" signs. I have tried to go to my personal physician, but his office staff tell me my doctor won't see me because of where I fell. Wal Mart will not refer me to a physician either. The Wal Mart representative tells me that I have to take care of all my medical treatment on my own, and that they will reimburse me after all treatrment is completed. I went to the ER and based on the x-rays, the ER doctor feels I may have a buldging disc in my lower back. I was told to follow up with a neurosurgeon. I am starting to get a little scared, I am not a wealthy person and now I can't even use my insurance. I don't really want to sue Wal Mart, but I'm starting to feel like I am being taken advantage of by one of the wealthiest companies in the US.

i could smell this one a mile away. Your probably the same type that sues over hot coffee. Take your winnings and buy a book on common F'n sense. DONT WALK ON WET FLOORS, that or get a new pr of glasses

You won't get an attorney to touch the case with a ten foot pole. They avoid WalMart like the plague. My 87 year old mother had an accident there last year. A huge item from the top shelf fell on her head and caused a head injury. The employees just stood around while my mom laid on the floor. She got her friend to call an ambulance. The hospital and doctor bills were around $30,000. She couldn't find an attorney to take the case. Walmart offered her $1,500.00 which she refused and Medicare paid the medical bills. The time limit ran out on the case before she could get an attorney to take it. They are all afraid of Walmart.

Too many people in this country are quick to sue others, you dont' seem to be one of them. There are circumstances when it may be the only option to get the help you need. This seems to be one of those situations, as they're not doing much to help you get treatment for the injury you sustained because of they're lack of posting the proper wet floor signs. You can look in the yellow pages for a personal injury lawyer and get some advice. If you need to have your spine taken care of, it may be the only way you won't be asked to pay money you don't have. Yes, you can use your insurance. Have your primary care refer you to a neurosurgeon. He or she doesn't have to see you for that. If he won't do it then call your plan representative. There's no way you should have to shell out any money above and beyond your usual co-pay.

Might also want to talk to the benefits person where you work. They might have better insight, or can at least point you in the right direction.

Feel free to make a pest of yourself with your insurance company. It doesn't bother them to take your and your company's payments ever week. Shouldn't bother you to call them on a daily basis.

Whether you should sue WalMart is up to you. If they take any action it can be seen as acceptance of liability. They're hoping you will go away.

When I worked in HR 15 years ago we had a $30K threshold. If we could settle for $30K then it wasn't worth taking to court. It's called 'nusiance money' in the business.

I feel outside a wal-mart on black ice, a a warm day, can you belive that. Everyone saw it, so wal-mart was more then willing to pay my medical bills. Sadly, they often won't if others did not witness your fall. Sadly, you ahve to know to take down others names and phone numbers when you fall. I never sued, like they thought I would, but I did want my medical bills paid for. You usually do have to pay first and then they'll pay.

Did you fill out an accident report with the manager the day it happened? If not, you may not even have a case that could go to court. Was an ambulance called? If yes, that can help your case, to get your medical bills paid and lost wages. Please don't be one of the American asses and I am an American, but we sue for Millions and never care about the affect that has on others. When people sue, the store doesn't absorb that cost,t hey pass it on to the consumers, so we pay, not the stores.

Also, a slip and fall is the favorit of con-artists, so proving your case will be twice as hard, because even the courts know that slip and fall law suits more often then not are a con.


Sadly, you will probably have to get an attorney to help you even to get your medical bills paid and lost wages. Sadly, they'll sue for everything and it will get passed onto the consumer.

I would suggest a GOOD Chiropractor. WHY? Find one that others trust, one who'll take the time to really look at your injuries. WHY? A buldging disk can often be corrected non surgically by a Chiropractor, through manipulations of the spine and teaching you exercises to help keep the disk from having problems in the future. Be careful about fusion and that is often what a neuro-surgeon will suggest. It's one of those surgeries that can help a lot at first, but seems in five year to have a lot of problems that follow. So use wisdom and pray to know what is right for you to do.

If you have a limited income, look in your phone book for LEGAL AID or NIGHT BAR. Night BARS are often free legal advice adn they could then direct you to the right type of legal services you need.

Do not get an attorney who asks for a retainer. Most who handle your type of innuries, get's paid when the case is solved. Do not agree to any attorney who gets more then 10% of what you receive if you win your lawsuit. Too many take any case, sue for tons nd take up to 60% of the money awared, so that by the time the person pays taxes, pays thehir medical bills, they are left wtih nothing. So make sure it's someone who will sue for actual coverage of all medical bills related to the injury, including counseling if needed and future medical bills due to the injury. Make sure if you can't do your job anymore, that they will pay for schooling so you can be retrained in any area of your chosing. Make sure that you will be compensated for time lost from your job. Make sure that they will cover housekeeping help you may need as you heal as well as child care for children. Then it's reasonable to ask for 10,000 in suffering, but don't go for hundred's of thousands, because we the consumer are paying this bill, not wal-mart. Make sure all attorney fees are covered under the suit a well; so you won't have any to pay.

Don't believe the lie that suing a big company hurts no one, their insurance will cover it. Because the cost is ALWAYS passed on in higher prices to the consummer--always.

If wal-mart isn't working wtih you, they never will. So you will need an attorney. Try seeing if you have a local nigh bar where you can get some free advice. If not, then look up LEGAL AID in your community resource section of your phone book.

Then take care of you back; do not lift at all until you have been seen by some form of spin specialist. You could make your back worse.

I wish you the best; an injured back if not treated correctly can have life long consequences, including problems with pregnancies, problems walking, etc.

Take care and get legal advice right away. If you cann't find it in the phone book or through friends. Go on line, type "Free Legal help+your city and states name" into a search engine and that should help you come up with local resources. Also your state's Bar Association can tell you of any free legal services in your area. Just type in your State and Bar association like this and it will come back with how to contact them. Example: "Arizona Bar Association" or "Arizona Bar+Legal"

Get a lawyer they deal with cases like yours all the time.
Ring a few first though sound them out, a good one will not charge anything up front just a percentage when you collect.

Any attorney will take your case, no win, no fee.
Negligence is obvious.

I'm surprised at Walmart. The mgr. is nuts.
Don't sign anything with Walmart until you talk to the Atty.

Good luck with this one.

You should have reported your fall in the store when it happened. Now you have no "witnesses" or documentation that you fell there.

They would have filed a report in the store and given you a copy.
