Okay, so i'm 19 years old and I got an underage drinking citation at a club. the club was for 18 an older, but someone knew someone and we weren't asked for our ID's and we were given bracelets indictation we were 21. A guy bought me a drink and gave it to me, and right when he gave it to me, an ABC cop asked me for my ID. I got the citation for possession of a mixed drink and misrepresentation of my age. I'm a good kid, no record, college student (pre med at that) and really don't want this on my record. What are my options? Lawyer? Take a class? How much will the fine be and how much is the class? Is there any way to beg for a LONG probation instead of a huge fine , since being a college student, i really don't have the extra 300 dollars to pay. The ABC cop told me i'd have to talk to a probation officer and not a judge. Any ideas? PLEASE PLEASE HELP! Also, why am I getting lawyer letters in the mail? Thank you!

P.S. I live in INdiana, but got the citation in Kentucky.

If you were a good kid you wouldn't have accepted the wrist band and the drink, so how about we drop the "i'm so innocent" routine, okay?

Get a lawyer in Kentucky, in that town. Talk to him. Be prepared to pay out some cash. Be prepared for probation, try to get adjudicated probation.

Be an adult and take it like an adult. You screwed up, you got caught, now be prepared to pay the price. That's how the real world works; school's out, play time is over.

With it being out of state you should get a lawyer from that state that knows the laws. All states are different when it comes to penalties. In FL teens usually go through a teen court, get a fine, and if they have not been in trouble before get community service and probation if the judge decides on it. Consult a lawyer from KY to find out what your options are. However, you knew you were not 21, and you should have never accepted the drink. Taking the bracelet could cause the one who gave it to you to lose their job, the business to be fined, and lose their liquor license. All actions have consequences.

I feel your pain sweetheart.
But I have to say that what I hear you asking is this.
If I break the law and I'm a good kid, no record, college student (pre med at that) and really don't want this on my record, how can I get out of it ?
I mean is this what you're asking?
I'm not being judgemental. I'm a former cop and I'll just tell you the truth.

99% of every criminal says, pretty much, the same thing.
Maybe not in your exact words but the same thing.
How do I get out of taking any responsibility for what I've done?
You seem like a good person, I don't know, but you're an adult, a college premed student (at that) and you have a brain. I believe you need to answer this one by yourself.
My advice:
Why not just don't break the law?

Well, there isn't much you can do. You're lucky you got the citation in another state though, b/c it won't be on your record in your home state. You are going to have to pay the fine. You are getting lawyer stuff in the mail because a case was filed against you and they all want to represent you.

Bottom line, you did the crime, now you gotta be prepared for the consequences. That's what life is all about.

See http://www.lrc.ky.gov/krs/244-00/085.PDF for the Crime itself
See http://www.lrc.ky.gov/KRS/534-00/040.PDF for the fines ($250 max)

Basically, its a slap on the wrist, unless you can prove to the judge that the guy just randomly handed you the drink and you had no intention of drinking, which is far off since you accepted the wristband.

Good luck with it, I'm sure you will be fine!

Begging for probation instead of fine probably won't get you anywhere. The judge may give you some choice in fine vs. community service, but unlikely fine vs. probation.

Sounds like you should be more responsible and follow the law.Glad you got caught and glad these ABC cops did their job.If more of them did it maybe we wouldn't have the rampant alcoholism we have in this country.Alcohol is not a good thing take it from someone who's father was an alcoholic. You should change your opinion on underage drinking and alcohol in general and be more responsible.

Honey whatever the penalty I hope you have learned a lesson. This may be a wake up call. What if you were drinking and killed someone, this can't be fixed. I know you're a nice girl, but drinking only leads down a long sad road. The same with drugs.

You shouldn't have accepted the drink from the guy. Sorry about your luck.

If you're such a "good kid" then why'd you let them tag you as 21? You may be "good" but you're not a very bright one...
