PENNDOT cannot take your license unless you have been convicted of,or pled guilty to a suspendable offence. The DMV can only act on paperwork from a court,be it a local magistrate,or county court. You have to be proven guilty first. You actually could go into the DMV and say that you will drive drunk/wreckless/or whatever,(this would be a stupid thing to do) they can do nothing until you are either convicted,or plead guilty. Number one, it would be just plain stupid to walk into a PennDOT office and say something like that. If you get too many points on your license, like from speeding tickets and such, PennDOT will revoke your license. The police, on the other hand will enforce traffic laws and issue a citation for an offense, but do not, usually take your license. PennDOT can, in fact revoke your license and refuse to issue a new one to you if you are found guilty of certain offenses.
