Now they tell me they are going to charge me for assault. It's not like I hit them or anything and I wasn't feeling good. I can't get charged can I?

It was an involuntary act, therefore no intent, which is required for the assault charge to stick.

Question is did the vomit stick? Or just sort dripped of his face.

It will depend on if you appeared to do it on purpose. Sudden projectile vomiting is something that can not be helped, but if you knew it was coming and did nothing to avoid splattering another person with vomit, you can be charged. What do the witnesses[if any] say?

That's not assault, the charge won't work.

If you were sick and couldn't help it, the charges will not stick. Now, if you deliberately turned towards that person and let go, then that's a different story!!

If it was determined to be intentional, it can be assault by bodily fluids. This is a first degree misdemeanor where I am from.

It will turn on whether you tried to hit them or not. Technically the contents of your stomach can be construed as a biohazard - same as trying to stick someone with a needle.

Sure it's far fetched, but you probably wouldn't be the first.

In a country where fat people can sue McDonalds and a thief can sue you for getting hurt while breaking into your house. I would say yes!
