this is what happened and i need to know what is gonna happen to me......
A few weeks ago i stopped at a gas station and as i was leaving the counter the cashier said you left your card i grabbed the card and walked to my car. I then went to the pet store a few miles away i realized the card wasnt mine and stupid me just threw it on the ground (dumb mistake i already know). Well yesterday a police officer from a town about 45 minutes away calls me cause someone used the card and they think it was me!!!!! I told him what happened and he said on the tape it shows me looking at the card at the gas station which it could look like casue i walk with my head down. They didnt look at the video from the store where the card was used yet and obviously I'm not on it but can i still get in trouble? I've never even been to that town and i didnt do anything that day except go home and watch TV my BF was at work and i had the day off. I have been lied to the police before and i got in .....

trouble bofore for something i didnt do i dont want this to happen again im just now getting rid of that and am trying to find a new job i feel that my life is going to be ruined again for something i didnt do. I need to find a new job and its so hard with a criminal record.
Any advice would be helpful THANKS

ok I AM NOT LYING--that is what happened--and to clear it up i wasnt the one that used the card i grabbed it cause i had used MY card at the gas station and when the cashier said you forgot your card i thought i left it on the counter then when i realized it wasnt mine i threw it out and yes i know that was irresponsible but thats what im wondering is -----can i get in trouble for throwing the card out i didnt ever use it

why didnt i take back the card?? i dunno i was in hurry in a cranky mood that day didnt wanna mess with it i didnt think throwing out was a big deal i now realize it was but a mistake is a mistake i feel dumb for it now but its a lil too late

As everybody have told you by now, you *should* have returned the card to that gas station, or failing that, DESTROY it completely (shred it or burn it or whatever). By tossing it, someone else got it, and you're the last person known to have it. And you can't prove that you no longer have it.
While it *is* circumstantial evidence, it *may* be enough to convict you of theft, depending on how good the prosecution is. However, it was still at the investigation stage, or else you'd already be arrested for theft and credit card fraud
Basically they ran the transaction records, found the disputed stuff, and the gas station. Gas station clerk remember you, and video tape confirmed it that you *did* walk out with a card that's not yours, based on what the gas station clerk said.
However, being stupid is NOT a crime. If you have been cooperating with the police, they'll check the video at that alleged defrauded place, and compare that against your DMV Photo (I *do* hope you gave your name and license # truthfully) and realize there are no similarities, and you'd be off the hook. However, you really *could* have prevented all this, but that's belaboring the point.

I dont know about the state you live in, but here in Texas in order for an offense to have occured you have to have had an intent to defraud the owner of property. You have to have knowingly, or intentionally committed the offense. By just throwing the card on the ground after you used it doesn't look really good. You should have called either the police or taken it back into the store you used it at. I am not really sure about your states laws. I would arrange to make the payment to the owner for what you used, it is up to the credit card company to take care of the other fraudulent charges on the card, but dont be surprised if they contact you again, you were the last known person to have possession of the card.

never throw a credit card on the ground!
chances are someone stupid will pick it up and
use it, therefore comitting identity theft!
yes, you should have either mailed it back to the credit card company (whose address appears on the back of the card) or taken it to the gas station when you realized it wasn't yours.
now, you are going to be investigated and probably charged.
be more careful from now and don't ever throw a credit, debit, social security card, or license on the ground again.

Yeah, throwing it on the ground was what screwed you over. You should have thought about what you'd want someone to do if they got your card by mistake before doing that...
Edit: Find an alibi for the exact time the card was charged.

The best thing to do would be to let the police finish their investigation. they will get the video where the card was used and do a writing comparison. If you did not sign the charge slip it will show in the writing.

Wow.....you did make someone mistakes. You should've not thrown the card on the ground, because it shows you are trying to hide something. I guess you could say that you realized it wasn't yours so you didn't want possession of it. If they give you crap about the video images, insist that they are being scandelous and to look at the gas station video. It seems like they are setting you up, so don't take their crap. Police can be very fradulant at times because they're on a power trip!!!

if you can prove that you're not the one who used the card, you get off easily. (for example, if a surveillance camera at the store caught that person using the card, then that's proof). you shouldn't get in trouble for throwing the card on the ground. but you should have turned it in. good luck.

I would demand some kind of attention be put on the person who used it at the pet store. Something doesn't sound right here and I would trust no one. If it isn't dropped I'd tell them you are getting a lawyer and get one.

Lucky for you, stupid is not against the law. Why didn't you just take the card back? Would have been the right thing to do and you wouldn't be worried about this now................

They have to prove you used it by a signature, fingerprint, you being in that store, more than just circumstantial evidence. But you still need to get a lawyer who is an expert in this type of defense.
