There is a chance I might have gotten a girl pregnant and she has a boyfriend of 5 years. The problem is he has already told her that he is gonna stay with her even if the kid isnt his. I have no problem in paying child support since it might be my kid but here is where i'm having a problem. The guy she is with has a history of domestic violence, he has no job, and he does coke on a regular basis, and he is on probabtion right now. She loves him and I know she wont leave him even if its my kid. But if it is my kid I dont him in that kind of enviroment, they can barely make it themselves, so they can't afford a new born baby. so with his criminal record and them not being able to support them kid themselves, can I try for full custody.

You need to get a DNA test done when the baby is born. You have a VERY high chance of getting custody if she is living in those conditions. Women that care more about the abusive men in their lives than their children need to have the child taken away from them. I would NEVER subject a child to that kind of life. I sincerely hope, for that baby's sake that you ARE the father.

You can try but the thing is, they aren't really going to look at the boyfriend until "something" happens. It will just be you against her. You need to try to prepare a really suitable environment for the child. And, no matter what, even if you don't get full custody stay in contact with your child. My ex does not keep up with my daughter because he doesn't want to have to deal with me (I am not bad he is just a wuss) so now he is the one missing out on my daughter's life and she considers my husband her dad. Good luck. You may want to go ahead and speak to a lawyer now.

You can fight for custody all you want. Unfortunately the mother usually gets custody. But if you think you can put up a good fight and if you can get a lawyer that will definitely help. If the court sees you are more fit to care for the child than she is...well good luck to you and I hope you get the kid. I would definitely talk to a lawyer if I were you.

usually in circumstances the place the mothers and dads have been by no ability married, the mummy is quickly the only criminal custodian. Later you are able to go after joint custody, yet initially she might have each and all the custody. i could ask for a DNA try if I have been you, merely in case. as quickly as this is finished then they'll parent up the quantity no count if it is your newborn. no count if it is your newborn, you will could pay newborn help. How lots relies upon first on what state you reside in, & 2d the earning & deductions in touch right here. each state determines newborn help in yet in a different way. some states like long island & TX use a flat fee equipment, the place they only seem on the paying mothers and dads earnings & you pay a fastened proportion of your earnings around 20% for one newborn. Then different states like OH & OR use an earning shared sort, the place they seem at the two mom & dad's earnings/deductions. there is an extremely long in touch worksheet and there is no fastened fee on what you will could pay. as far as visitation rights, you will could ask for them in writting to a choose. you may in all possibility do it around the comparable time because of the fact the newborn help stuff so as which you're no longer likely back to court docket later down the line. some states like TX will communicate visitation quickly on the comparable time as a newborn help listening to, yet maximum states won't even advance visitation till that's a written court docket request. see you later as you ask for it, you will get it. the only way they are in a position to maintain you from getting your visitation is while you're a druggy, alcoholic, abusive, or different issues like that. If I knew your state i ought to grant you some greater effective information. sturdy success & be at liberty to e mail by using my profile.

My first step would be the paternity test. Then go from there. You can always apply to the court for full custody, whether you get it or not is another story.
