Your rights are simple. Park the lemon outside the dealership with massive signage indicating your dis-pleasure with your purchase & see how quickly they decide to fix it.

If you bought it privately - throw a message brick through the front window of their new car. Wont get anything fixed (but least you feel a lot better)

Check out official New York government website - maybe you have one in your country / state.

As an ex-car salesperson I can tell you that your rights are limited with used cars. In Arizona there is a 3 day rule. You can return a car for a full refund within 3 days, but only if it's got something major wrong with it that makes it unable to run.

Unless you bought a warranty (or the car is still under warranty) you're on your own for repairs.

If you turn it back into the dealership they might take it back and put you in a new one (if you purchased it recently). BUT, some dealerships will list the car as a reposession on your credit. Other ones will treat it like a trade-in and give you trade value for it. Which means rolling negative equity into a new purchase.

If the car is truly a piece of crap you might try getting pre-approved for another loan and trading that one in. With pre-approval you will know exactly how much you can purchase and can shop for the best deal in your area, and this time take your time and make sure it's a good car.

Check out trade-in value for your car at www.kbb.com before going anywhere. You're probably going to have to trade it in to get out from under it so you might as well know going in what you're into it for.

As a previous used car dealer I told all my customers to take it to a mechanic and have it check out and then if they have a problem with it within 3 days that we didn't know about to bring it back and we will check it out and usually fix it. But most used dealers sell it as is no exceptions so be sure to have it checked out before you buy.

You have no "rights" when you buy a used car, other than the right to keep making payments. It was your responsibility as buyer to determine the condition of the vehicle before buying it.

But what if the used car you buy has a KNOWN problem, and you are not informed of it? What if the car you buy was unsafe to drive from day one?

Did you get a written warranty? If not, you're screwed.
