Ok so my friend Nick is having a party at his house with alcohol on Sat. night and his family won't be home. Problem is his mom assumes there will be a party so she said to Nick that a cop that is a family friend will be checking up randomly between Sat. and Sun. The party is only me, my friend nick and 3 other friends.

So the ques. is can this cop break in the house without a warrant even though he has reason to believe there is a party. Also no one is driving home that night and the party wont be happening till after midnight.

oh yeah and were going to make sure there is no loud noise and the doors are all locked and windows covered up.

I also forgot to mention before that this cop is a New Jersey cop while this party is in PA.

The cop friend already has permission to check on things.

This is not break and entry. If asnyone of you attempt to prevent him from doing so, you can be charged.

If there is probable cause that a crime (under age consumption of alcohl) is being committed, the police has the right to enter a premisses with out a warrant.

Keep the party legitimate; you may spend the rest of the weekend in the Lock-up.

I ******* hate pigs !!! Why aren't they out looking for murderers, child molesters, and rapists instead of hassling a few kids. As long as you are being safe, not driving, etc I do not see a problem. Face it kids will be kids. We all did it. It is a rite of passage.

As for a suggestion maybe you should have the party in another location. ?

Whatever you do, Do not give the fascist scumbag a reason to come and check up on you

Remember just because something is a law does not make it right. Other countries have lower drinking ages or none at all and they don't have the problems with this that the US does.

as long as it is mothers house she can give permission IE consent for the person to come onto the property and check on the place

now the fact that the cop is a NJ cop and the place is in PA means the cop will have to call the local police if he shows up and finds something but it will be legal since he has permission

Are you kidding? Apparently the "mom" has a clue what may happen! So when her "cop" friend shows up and you all get busted, yes he can enter without a warrant there has already been consent and probable cause!!

Be on your best behavior and DO NOT disrespect your friends family's wishes! Lucky your not my kids!!! Is an MIP (minor in possession) worth it? Think about the trouble you'll be in!!!

If the cop is a family friend, then the parents may have already given him a key, and permission to enter.

No but if he or she is a family friend then they can go right on in with permission for the parents.
