If you're actually drunk then I guess it's better to...
...but what if you've had alcohol and you're underage but you're not yet drunk...just had enough for it to show up on a breathalizer. They would still charge you since you're underage but is it better to just wait and hope by the time they get you to a station the alcohol will no longer show on a Breathalyzer?

First of all, underage drinking is illegal. There is problem number one. Secondly, how do you know if you were drunk or not? Did you do a self BAT (Breathalyzer Test)? Just because you didn't FEEL drunk doesn't mean that you weren't. And thirdly, I know all kids will drink, but is it really worth losing your license or possibly being in an accident that takes someone else's or even your life? I know you all think that it won't happen to you..... but there are 15 kids from our high school that thought the exact same thing last year, and they are all dead now. Think about that one for a while.

It's never a good idea to supply evidence against yourself unless you just want to do your time and pay your fine. Most criminal defense attorneys suggest being courteous and cooperative but do not make statements or supply evidence against yourself. If you know that you are not drunk then as the guy above said demand a blood test. In our county driving on a suspended because of DWI carries a $350 fine and an automatic 10 days in jail. Driving with no license with a recent DWI is only a $110 fine and no jail.

tallerfella: in some states you would get off easier if you never renewed your license if your gonna drive drunk. That license is in effect a contract with the state that you will abide by their traffic ordinances and other laws without question. It's a lot worse to get caught driving on a suspended than just driving with no license.

While I don't encouraage drinking and driving...if you get pulled over, request a blood test. The reason: the breathalyzer will be administered right away...to get a blood test, they have to take you to the hospital, get a nurse to draw the blood...that all takes time and the delay could allow you to sober up enough to be under the limit.

either way you are screwed. When you got your license, I guess you didn't read the "applied consent" part. Refuse to take the test and the penalties can, at times, be worse than if you blew into the machine.

If your not driving there would be no need for you to take a bac test. A simple field sobriety check for a minor could determine if you are drunk or not.

If you refuse to take the breathalyzer test, when you reach the police station, they will have obtained a warrant to take a blood test and you will still be charged for intoxication anyway!!!!

Never take a breathalizer. You have the right not too take it. You will loose your license for 6 months, but it doesn't go on your record.

I had a guy refuse the test. He then appealed the suspension of his license after getting a delay on the DUI Charge.
The appeal went to his home jurisdiction where his father was a judge. He still got nailed but it was a nice try.

Waiting could back fire on you also. Depending on how long ago you quit drinking you may not be at the peak of your intoxication and by the time that you get to the police station you may actually register higher.

DO YOU LIVE IN OHIO ? JUST SAW SOMETHING ABOUT THIS SAMETHING A LITTLE BIT AGO. HERE IT IS IN THE NUT SHELL IF YOU WANT TO ACT LIKE AN ADULT THEN ACT LIKE IT NOW AND . THE ONLY WAY IT WON'T SHOW ON A BREATHALIZER IS IF YOU LIVE IN CHINA. GET THE PICTURE ? THE LONGER YOU WAIT THE STONGER IT GETS TO A POINT

if you wait and go to the station you don't get a breathalizer, you get a blood test. Which will show a higher alcohol level
