It depends. Was it part of a construction zone, clearly marked as closed? Was the contractor using due diligence to ramp 4:1 all vertical edges that might be driven on. Were you obeying the speed limit and all construction related warning signs? Did you take pictures of the location where this happened?

When presenting a claim to the city, remember to include as many verifyable facts as you can.

Get pictures of the traffic control (signs, cones, arrowboards, flagmen, etc...), pictures of the vertical edge where the damage occured and pictures of the damage.

Note the time of day, location, direction of travel and speed.

Many cities will have a claim form for you to fill out and probably will probably ask for all this information.

Good luck and don't delay in contacting the city and/or the contractor.

P.S. Don't get angry or yell at or abuse your humble public servants or contractors. Just present the facts and perhaps get a lawyer if things don't turn out for you.

Some cities will actually pay for damage causes by roads out of repair. File a complaint with the Dept of highways and see what they have to say. If you get the run-a-round, then get a lawyer and do what he says. good luck.

Will the city pay for it? No.

Is the city responsible? It depends on a lot of specifics such as was the work crew city employees or a contractor (under what terms?) and was the roadway faulty or unfinished?

Were you speeding in a construction zone?

I would think so. If they were repaving and didn't have any signs about the BIG *** HOLE in the ground. Did you pull over after it happened or did you drive it off? lol Just wonderin for some reason.
