i was arrested in 2004 for a misdemeanor of petty theft, went to court & had it resolved by going to pretrial diversion. i paid the fine of $75 & that was that. my only problem is i am now applying for a bank position where i need my fingerprints taken & it will no doubt show my criminal history. how can i get that misdemeanor off my record!?!

It will never leave your record.

The only thing you can do is contact your state's Attorney Generals Office and ask them what the procedure is in your state to have a crime expunged from your record.

This is a long and drawn out process that will require the help of an attorney and many court proceedings.

Many crimes are never eligible to be expunged.

I think it depends on where / what state/country it happened. I think you are talking about expungement/sealing. I think that in some places one call even be a felon and have it expunged after a year waiting. The idea is that it gives the offender a second chance at life / enables them to get a legal job instead of returning to crime as a means of support. See a criminal attorney for a consultation where you live and ask. I think that you could disclose the matter to the bank and probably be considered. I think that you should consult a good employment book to learn how to answer difficult interviewing questions. Interviewers don't always have a lot of candidates to choose from. I would think more of a person who I thought had a misdemeador and appeared to be honest / had remorse than someone who had a clean record and several bad references or no references. Gaps of employment that I couldn't figure out. Of course, if there is a candidate that has no record AND seems like they are honest , that 's the preferred one. I think how you do damage control is going to be key. Even if it gets expunged/seals , things may come up , I would figure out how to answer questions so you are prepared for the future.

There's really no way that I know of to get around it, but it is possible to still get hired (like my friend did). Just be straight forward and tell them you were young and stupid and show them some proof that you've taken the efforts to be "rehabilitated". It's a 50/50 chance but it's better odds than if you don't tell them and they still find out!!

Unless the crime occurred while you were a juvenile, a conviction will not be removed or sealed.
