Here is the situation. Four years has passed and no payment has been made at all on the credit cards. What if within the four years the Company has sued the person before SOL is over and the person wasn't aware or know he has been sued because he was outside the United States sick. What will happen then? thank you

As long as they file the lawsuit before the SOL expires you can continue to sue you.

Also, when you leave the country the SOL is put on hold until you return....so once again you have no dodge for it.

Did you get a default judgment against you yet? If you were out of the country and the creditor knew (or should have known) then how did they serve you with the summons? You may be able to fight a default judgment if you can show the judge the service was not done correctly.

expensive Jenna, in case you get to any extent further calls or letters threatening a lawsuit over the credit card debt you may touch the Minnesota legal expert primary's workplace (below). I strongly suspect the statute of barriers has exceeded. oftentimes, it starts off to run from the date of the final value, and oftentimes that is approximately 3 years. even with the incontrovertible fact that, the perfect regulation won't be Minnesota's--that is regardless of state is specific interior the unique credit card contract. If the debt exhibits up on your credit record, and that is extra desirable than 7 years previous, you are able to touch the credit reporting corporation and ask to have it bumped off below the essential credit Reporting Act.

Did the credit card companies get judgements. If so, those judgements are good and the SOL does not apply.

If no judgements, or the suit was filed after the SOL, then the SOL applies.
