Do you have uninsured or underinsured motorist coverage? This is what it is for. If not then you can take them to court and try recoup your losses. But I've found that people without insurance usually don't have anything to pay a judgement with either. Can't get blood from a turnip.

but???? Unfortunately all you can do to try to recover the damages is take them to court. However, in most states it's illegal not to have at least minimal insurance (usually $10K, sometimes less), so I would report them to the police, if you haven't done so already.

That's what uninsured motorist clause is for. If you have that on your policy (which you're suppose to), then your insurance company should pay for the damages.

but what? Not having insurance doesn't take away their responsibility to pay for your damages. Get their information and turn it in to your insurance who will attempt to collect from them.
If they don't pay, you can always take them to court.
