The only way to get them to pay for the damages is to sue them. Your insurance should have uninsured motorist coverage that will fix the car, but if you want to get your deductible back you have to sue. And if the Insurance company wants their money back, they will sue too.
If you don't have uninsured motorist coverage you'll have to file a lawsuit for the entire cost of repairs. You'll have to pay for the repairs out of your pocket and then the lawsuit (if you win) will reimburse you for money you've already spent. And even if you win a judgment against them there is no guarantee they will pay. A judge can not force someone to pay, all they can do is say you lost, you owe.

Yeah, I've heard that before also. We'll pay you out of our pocket. Then you never here from them again. Happened to me some years ago. The thing you should do is to call the police and get a report. That way if they don't pay then your insurance company can go after them. You hate to be this way, but at the time, we were living paycheck to paycheck and didn't need the extra cost of some jerk hitting the side of my car. We didn't call the police, and by the time we realized that they weren't going to pay, there was no record of it, and they can deny it, and say it wasn't them.
Good luck and I hope they pay. However, do get a police report on it. Why are they driving without insurance? What if they killed someone?

Get a police report an estimate turn into your insurance company or have him pay you. Small claims court??

Do you have uninsured motorist insurance? If so all you(your insurance agency will take care of this) have to do is prove they don't have insurance and poof it is taken care of!
