I live in NY state...I was involved in a minor accident recently. The police report assigned no fault to either party. Essentially, it is a he said/she said case. I did not file a claim since the damage to my vehicle is so incredibly minor. However, the other party did.

What would happen if my insurance co. assigns equal fault to each party? Will I have to pay anything out?

in a no fault or equally at fault case, you pay your repairs and they pay for theirs.

What makes you think they will assign 50/50? If its he said/she said.. thats even more reason for it not to be 50/50.

Likely, their insurance will side with their story and your insurance will side with yours. Just to give you a heads up.. there insurance WILL tell your insurance. why dont you call them to give them your side first?

And then you will both have to go through your own policy.

Later, after damages are paid.. both companies will have a third party review the claim and see if they can determine fault.. if they can... one company will reimburse the other. But if its word vs word.. i doubt they will even bother.

The total damage will be added up and divided by 2. Each insurance company pays half.

Police don't assign fault in a routine accident report.

No you don't...................just show the police report as proof (that states taht neither party was at fault) then you're good to go.

You should each go under your own policy for coverage.
