It's not that they WON'T give it to him, they did tell Hendrick what it would take to let Jr. have it, it's that their demands were unreasonable (according to Hendrick). That being said, it seems as if this is Teressa's way of giving one last middle finger to her deceased husband's son. Jr has said he would like to run with the number 81 next year since he can't get 8 (he's run 81 in the Busch Series).
NASCAR does own the numbers and leases them out to the teams. Currently DEI has the right of first refusal on the number 8 and will keep it with the organization.

Before we start the witch hunt,I'd love to know how hard Hendrick tried to get the #8.Rick H. sort of said it all during the press conference with Jr. that he would need a bigger gift shop.I thought getting a new sponser would be enough to get all the Jr. fans flocking to buy new Lil E. garb,but maybe the tatoo lobby got together too and got Hendrick to go with a new # too.Can't imagine Teresa sees any value in holding onto the #8,but I can see millions of reasons why Hendrick wouldn't want it.Thats just my take on it,like I said I'd love to know for sure.

Do I think Hendricks tried to get the number, sure, but probably not real hard.
Do I think Jr. will still be as popular next year without the #8, the color red and Budweiser as a sponsor - no, I don't.

I can't help thinking about the commercial last season where he states that he is going to change his number, and everyone goes nuts. It is a pretty funny scenerio.
There will be billions made off of the Jr. nation buying up all his new garb now.
Financially this is going to be his smartest move ever.
I just hope for his sake that he starts driving now. The excuse will soon be gone about his equipment.

DEI has the right to keep the #8. Jr should have known he would have to leave it behind. He should forget the 8 and drive with another car number. I can't really see what difference a number makes.

Whoever said it's NASCAR that owns the number is right. I checked on nascar.com and it's mentioned in the reporting on this story.
Personally, I can understand why Hendricks tried to get the number, but in the long run, I think it will be better for Junior to make a clean break.
Or, maybe he could honor his Dad by taking 33. I just checked the NASCAR website, and it's not taken...

I'm confused as to what is unfair about this situation? Players in other sports get traded or sign with other teams, if their number is already taken they get a new number. Its JUST A NUMBER. Besides, NASCAR owns the number not DEI or Theresa. Good old Jr fans, talk first, never think.

All I know is it sucks that next year it won't be Dale Jr #8 Budweiser it has been that way for along time and now who knows what it will be. It just looks like all his fans will have alot of stuff that is out dated.
