Our daughter enlisted in the Guard to help out with college expenses. Before she could graduate from basic, she broke her leg. She has been held back trying to get her leg better. She was just starting to run on it again and now we found out today that she has now gone AWOL with a group of 7 others. What happens to her now?

Get a hold of her, if you can, and get her to turn herself back in. She's got to get back before she is charged with desertion. Not a good thing durning wartime! If you can get her back to her unit, she may face some non-judicial punishment, and be able to get back on track with no black marks on her record..

She has 29 days from the date that she went AWOL to report to her unit. On the 30th day she can be charged with desertion during wartime. When she is found most likely she'll be picked up by MP's ( Military Police ) or regular police they'll run her name through there computer and the police will get a hit on her name and her militayr stats will read AWOL ( Absent Without Leave ). Chances are she'll be taken to the station if she's picked up by regular police and they'll call her battalion and somebody from her battalion will come and pick her up. She'll eventually have a hearing and then she'll get discharged but it will be a dishonorable she'll most likely get other punishments such as jail time.Or a bunch of Article 15's and alot of detail.

If she has been AWOL for more than 30 days, and she is stopped by any police officer, her deserter status will apppear on the National Crime Information System. For, after thirty days, that's what she is. A deserter. The police officer will take her into custody and she will be held in jail on a Federal detainer until the military comes round to pick her up. From there she will either undergo an administrative hearing and be granted an Undesirable Discharge. Or she can be court-martialed, with award of a Bad Conduct Discharge or Dishonorable Discharge, depending on whether she is sentenced by a Special Court Martial or a General Court Martial.
The same fate awaits the seven other soldiers.

They will freeze her bank account. Then basically wait till she turns up. Eventually she will have to go back mainly because she wont be able to get money (legally) or really own anything until the matter is cleared up. The sooner she comes back, the better off she will be. She will be charged in the UCMJ. But after time she will be labeled as a desserter which carries a maximum penalty of death. But the wont execute her for that so dont worry. If she goes back now she can basically get out from a "Faliure to Adapt" clause. Since she never graduated basic. I'd get a lawyer who specializes in military law. Just get her back, or she will be ruining her life.

She has 29 days from the date that she went AOL to report to her unit. On the 30th day she can be charged with desertion during wartime. Back in the day this could have got her hung! Beings that she is still in basic one of three things will happen: She could just get an article 15 forfeiture of pay, extra duty time, and a letter of reprimand in her file. She could get an other then honorable discharge. Or they could toss the book at her and put her in prison for a few days to a few years. In short the faster she returns to her unit the better for her.

She has 29 days to square it with her unit. She will lose some rank and pay most likely, but that will be about it. If she is gone longer than that, she is a deserter, and subject to court martial proceedings. She will receive either a Bad Conduct or Dishonorable Discharge, and mess up the rest of her life. If she contacts you, tell her to turn herself in before she gets caught. Since she bailed out of Basic Training, they might not be as hard on her.

Federal Penitentiary In Kansas is next. Hard time ahead! What a flake. It's a good thing this happened now before she was in a combat environment and cost hundreds of lives because of her stupidity! Sounds like she can run now. It would be best if she ran all the way to Canada and asked for political asylum!

she will probably be put in jail as soon as she turns herself in.Depends on what route the CO wants to take. I knew a guy that went AWOL in AIT and they jailed him quick. Hopefully they wont classify it as desertion because in war time the max penalty is death. But they hardly do that nowadays even though its still an option.

The bad news is that maybe there needs to be an investigation looking into the mass AWOL exodus. If your daughter had medical issues that placed her in a holding circumstance, then maybe she can have the enlistment contract voided due to the physical lack of abilities to fulfill her commitment. Either way I see a JAG investigation taking place and that will exsasserbate things if she doesn't make her presence known. Also make any VA claims difficult to achieve without the care she might be lacking.
