I am trying to get a new position at work, but my supervisor is hesitant because I have a school to attend for the military that is mandatory.

If your boss wont give you a position due to your military service you have legal rights under the USERRA Act. They cannot hold your military service against you. Whether that service is voluntary or not. Call your local American Legion and get the contact info for an Ombudsman and they will help you out.

If you are ordered to attend a school by the military, then your civilian employer is required to either give you back your same position or an equivelant paying position, plus raises, bonuses, and any other perks that you would have aquired while being away on orders. So yes you would be protected under USERRA.

Very probably however it has been so long since I was in you need to talk to your Battalion XO he is supposed to know or know who to ask!!!!

Jake, where did you get your information? No one has been drafted since the early 1970's when we went to a all volunteer military.

The act only provides protection for those that are drafted. Since you have voluntarily put yourself in that position why should any civilian agency have to hold or provide anything for you? All military people today are voluntary and have no such protections! I guess your another one that wants to eat their cake and have it at the same time!
