I know, this is kind of a stupid question, but I am just curious....If a person is here illegally, are they allowed to own a car? I mean, think about it...there are people from other countries who own vacation homes here and such....and they do not have any sort of US residency whatsoever. Sure, maybe when they visit they have a visa to enter the country legally, but as far as having any sort of legal documentation that identifies them as having any type of residency status in the US, they do not have it.
So, if that is the case, can a person who is here illegally actually own any kind of property, as far as actually holding the title to the property (house, car, whatever)?
The reason I ask is that someone mentioned to me that the illegals here in my area always use someone else to assist them in transferring car titles for use here in the US. It confused me, because it seems like they would be able to transfer the title themselves?

I realize they cannot register the vehicle or obtain license plates without residency, I am only referring to the transfer of title.

Yes, they can legally own a car. They just can't legally register, insure, or drive that car because they are undocumented.

Well there are very spefic IRS rules about this so you should check there.

According to law if you are talking abotu a vehicle it has to have a title. That's a legal document and you'd have to be high to buy property from an illegal where a LEGAL title is required.

The dude is already a fraud for being here illegally. Now he wants you to help him commit another FRAUD because of course he can't transfer LEGAL title...Think of all the crap you are bending over for. It is a crime to do this in any state. What also if the thing is stolen or involved in another legal problem? You just became the patsy.

Don't do business or become involved with illegals unless you want to end up their patsies and go to jail for them or get sued.

The "Mexicans are the Bes" person is misinformed and wrong. She posts this La Raza stuff all over the place on Y. Ignore her. Maybe you can get her to do all this fraud work though. Maybe she knows some underground illegal connection, don't know she posts a lot of really agressively negative stuff though.

Part of the problem with all the illegal Mexicans here is that they exist in a sub-culture of their own making, breaking the laws as they go about their business.
They always use their "cousins" or some other stooge to hold title to their cars. They will spend the money to get a SR-22 insurance card, register the car then cancel the insurance.
Sadly, illegals are allowed to own property and vehicles. Their property is subject to confiscation if they are rounded up by the INS, but since our government isn't doing its job that never happens.
In California, Jose Garcia owns 2 million cars.

If you cannot register the car in your name, it is not legally YOUR car, but actually belongs to the person on the title, regardless of who paid for it.

In some places, if a car is stopped and the driver is illegal/undocumented, the car can be forfeited. In my opinion, this should happen everywhere. If someone is supplying a vehicle illegally, they should lose the vehicle, and also get a hefty fine.

Even if an illegal does "own" something here...take them to court. Do you think they'll show up?

There is no law in the US requiring the seller of an item to verify the buyer's immigration status before transferring title. So as far as just buying the car, yes they can. Insuring and driving it is of course a different story.

They may be using someone else to do it for them because they are just afraid of the process in general, and they worry that if there are any problems (for example, if the car turns out to be a lemon and they have to go to court), then they will get caught.

They can do just about anything they want - just ask the American Government. I know in Colorado they can own, register, and drive a car all they want. Why would you ask this question, just look in the driveways of your Mexican neighbors. They all have at least 4 or 5 or more vehicles.

Actually....Miss "Mexicans are the best" is correct...but it depends upon what kind of property you mean.

As noted, things like motor vehicles and houses require titles; unfortunately, people who are here illegally may obtain those items only via illegal means.

Everything else is acceptable. If someone has money and wants to buy some clothes or books, then they may do so.

If they have the money, anyone has the right to own something, whether it be a house/car/ or whatever.

I see no reason why a foreign national couldn't buy something, even if he is here illegally.
