Actually, it is not his choice to make. The #8 is owned by NASCAR. The number is leased to DEI. The only way that Jr. could get the number would be if it were released by DEI. The only way that a number could become retired was if NASCAR was to retire it or if a team was to pay the yearly lease on a number and continue to pay it while not electing to actually use the number. One example of this would be like the current situation with the number 3. I believe that Richard Childress still has the rights to the #3, yet he chooses not to use it.

If the 8 was so important to Dale Jr. he could have stayed at DEI.

NASCAR does not retire numbers. If you were to retire the 8 then why not the 3,43,21,17. If they were to start that, there would be no more numbers to go around. As for the 8, David Poole has reported that the 8 will stay with DEI, as no financial agreement was made. That's as of 5:00 today.

NASCAR owns the numbers, Junior can't take it. It rightfully belongs with Dale Earnhardt Incorporated anyway. Why would any true Earnhardt fan want to banish that cherished number to a sleazeball like Hendrick?

B---h wouldn't ever give it up he made that number what is is or what it was, it don't matter what number Jr. is he'll always be loved by his fans, there is no room for the #8 on Hendricks team, lets leave it all behind and start fresh!!

Teresa Earnhardt has blocked him from taking the number 8 and she also owns the rights to #3, but wouldn't #83 be cool? Be his number and his dad's number also!

First thing, it is not up to JR. He can not take the number, it is not his. Second of all numbers in NASCAR are not retired. There has not been one NASCAR number retired because they only have so many numbers to work with.

The Number 8 belongs to DEI and the only way for Jr. to have it is for Teresa Earnhardt to GIVE it to him. It cannot be sold.... The decision lies purely with Nascar whether it is retired. They are not going to retire the #8 anyway...he hasnt accomplished anything. Look at Rusty Wallace? The #2 isnt retired.

Its official hes not getting the 8, numbers are owned and leased to teams by nascar.and numbers are not retired.
