Hi, I was in a car crash in which my friend was driving and, I was a passenger. I had to go to the ER and get x-rays, and med's. My question is that will I get a check for my pain and suffering? I know her insurance is paying my ER bills and x-ray, but I was just wondering that because I was just a passenger, and it wasn't my fault. Thanks

Generally speaking, the company of whoever was at fault, should pay for your medical bills. Pain and suffering will depend on if you have any doctor ordered time off of work as well as any permanent injuries.

Not automatically, you'll likely have to sue her first. AND the accident would have to have been her fault. AND you must be in a "fault" state, or you're not entitled to anything besides medical payments. Even if you are in a tort state, you don't state what your injuries are. Most of the time, you need REAL injuries - just going to the ER to get checked out doesn't count.

You'll need to consult an insurance agent or attorney there, to see if you're eligible.

For pain and suffering to pay out, you would need to be seriously injured which prevents you from carrying out your normal day to day activities for a long period of time possibly permanently or which prevents you from going back to your normal work (career) as a direct result of the injury. Otherwise, it was an accident and you will only get reimbursed for your medically necessary expenses under the auto insurance. To be blunt, it is not a money making experience -- it is meant to get you back to "whole" again.

Have your seatbelt on? That will be the first question asked if you are going to file suit which is the only way to get money for pain and suffering, if not you are negligent and part to blame for your injuries.
