this is what happened, in January my husband sold a vehicle that was under my name and of course he reported it to the DMV, in March we recvd a ticket with a picture of the new owner crossing a red light, my husband called them and they said they were going to pay and register the vehicle to their names, so now in August I recvd a notice saying I had to showed up in court in July and because I didn't I have to pay like $600.00 I called the number provided and told them that I didn't know of this and that this ticket wasn't mine, the new owners asked for an extention and they fail to pay, now I have to waste my time, take time off work and appear in court and show the judge all my proof that I'm innocent. I'm really upset we did what we were suppose to according to the DMV is not fair that now they are holding me responsible to clear all this mess. Anything I can do in court or to the people that we sold this vehicle to?

you can take them to small claims court and sue them for your time and loss of work

Here's the deal. When you sell the car, be sure to sign all the paper work at the DMV or county clerks office, which ever you have to go to when you renew your registration. Then you know that the car is registered in the new owners name. Like you I have been burned before, selling the car to a co-worker who said he would transfer the registration. I also learned that I am still responsible for that car as long as it is in my name. Luckily, all that I had to do was to pay some extra taxes, but now that I know this, that's the only way I will sell a car. I have had no problems since I started doing it this way. good luck.

Nothing that will not cost you more time. ALWAYS mail the release of liability to the DMV, and keep a photo copy for your records. I had the DMV keep my tax return for an error on their part. i sold a truck and mailed in the release. The new owner did not register it, I was charged for registration. I showed the DMV my photo copy of the release along with a photo copy of the stamp dated envelope I mailed it in. The DMV took my name off the record, but did not refund me.

I don't know what state you are in, but usually only the driver of the car is legally responsible for running a red light. If the photo shows that the driver is neither you nor your husband, neither of you can be held ciminally liable for the red light violation. It may require your going to traffc court to demonstrate that you were not the driver, but that may be what you have to do in your state.

In my state, when we sell a car, we are supposed to notify the DMV. They like ot be sure that the new owner has insurance coverage and that sort of thing. Maybe it is also to help them locate people who run red lights.

Shouldn't your husband have removed the license plates when he sold the car? I realize that won't help you now, but that would have prevented this whole problem.
