Which version of the 1099?
It's a fee that was charged and was then challenged on Constitutional grounds (related to the California State Constitution -- this happenned in California) and the fee was struck down. They are now required to provide refunds.

You don't file a 1099, if anything you would get a 1099 from the refunder. If you weren't able to deduct the fee that you paid on your taxes then the refund that you receive would not be taxable to you, and you more than likely would not receive a 1099. If you overpay your property taxes and get a refund on them, you don't get a 1099 for the overpayment refund.

If this was a deduction on either your federal return or your state return in the year the fee was charged to you, then you will show it as income in the year you receive the refund and report on the same form you used to take the deduction. 1099's are only used to show income so you may be asking which form do you use to report the income when you file. That will be determined by your other income & deductions and what type of 1099 you receive for the water fee. If you didn't deduct this fee on either your federal or state return, it's unlikely that you will have to report it as income when you receive the refund.

YOU don't file any Form 1099. The entity that refunds the illegally collected fee might have to give you one, however unless the fee was otherwise deductible there won't be any tax consequences from the refund.

A 1099 is not a form YOU fill out. It's a form you receive if someone or some business pays you for something other than being a payroll employee of theirs.

If you receive a 1099, then you report that on your income tax.

A refund of money you spent is not considered income.

The refund won't be taxable and you won't get a 1099, assuming that it wasn't some kind of local tax that you deducted.

you shouldn't have to fill out a 1099 for a refund, as long as you have papers for the courts, the refund should be available to you from your supplier.

None. You paid the fee with after-tax funds, and water bills are not deductible items.
