My husband is in the reserves, he's been in five years with a rank of sergeant and mos- personnel. He wants to go active but he has a prior domestic assault(serious misdeameanor) charge from over a year ago. He has completed probation and is no longer on it. So we were wondering if this would prevent him from going active.Thanks so much for your help!

To clarify this question- the domestic assault charge did NOT involve me- it was a fight between him and his dad when they both had a few too many drinks, his dad swung at him but he told the police he hit his dad first to keep his dad out of trouble. It really wasn't a big deal- his commander is aware of it and actually went to court on his behalf. Based on this information- what would be the answer to him going from reserves to active.

No, it won't prevent him from going active. All he needs to do is put in his paperwork, and have DA approval.

He should have been discharged since he is in violation of the Lautenberg Act. If he applies for Active Duty - the initial background check will show the conviction and action will be taken by informing his Command of the violation.

domestic violence is usually the kiss of death for any Military Career. Doubt very seriously the AD side will allow him to transfer over. He's lucky he got to stay Reserves, actually.

So he beat you while in the military? He should of been discharged. Domestic violence is a big no-no in the military.
