My dog is a small poodle two days ago while playing in the yard a new neighbor let her young son come into my yard (private property by the way) and he tried to grab my dog the dog barked at him now she claims that my dog is a viscious little creature and the animal control forced me to take him to the shelter for 10 days for observation I think this is not fair since my dog was in my property the little kid should not have come in and my poor dog now has to stay alone where there not going to care for him as I do (believe me you would feel the same way if you saw how the shelter looks) well i don't know what to do please help.

oh yeah by the way my doggy has all his vaccines up to date including rabies and he did not bite the boy he only barked at him but the boy claims he did althought the examined the boy and found no bite marks but they say that the dog scared the mother and she's preagnant so they made a big deal about that.

That is extreme, the shelter shouldn't have been able to keep your dog for just barking at someone on private property.
Are you sure there isn't more to the story? If your dog snapped at the brat, you should still have been allowed to 'quarantine' your dog at your own home for 10 days.

The law is very conservative when it comes to deadly diseases like rabies so if there is any allegation of a bite, the dog will be quarantined for observation. Most places allow this at home but many shelters get extra money besides what you will be charged and are corrupted so just do not allow home quarantine. Nothing you can do about it (although contacting a county commissioner or whoever is part of their getting the animal control contract can work wonders). Now, as for the neighbor, call the police and inform them that you told the neighbor that her and her kid are not welcome and if the kid again enters, she will be liable for the trespass. If the kid tries to "grab" your dog again, claim animal cruelty (she is responsible for her kid's actions). Glass houses and all that. You are already on bad terms so you may as well fight fire with fire. If your land is fenced, do lock the gate or your little dog might disappear.

Did the dog bite the boy? The reason they are keeping for 10 days for observation is because they are looking for signs of rabies. The only reason they would keep him in quarantine to check for rabies is if the dog bit someone. If your dog didn't bite the boy I can't imagine they would be allowed to keep your dog from you. Talk to them about the situation, and explain your story. But even if the boy lied and said that the dog bit him, I don't think there is anything you can do in that case. Just talk to them and see what your options are. Good Luck, I'm sorry that this happened.

If you love your dog, then why are you asking this question?
10 days is not a long time, if you truly love your dog?
if he is not vicious, then what is your next move?
My suggestion, sign your dog up (and YOU) for obedience classes.
THEN, seek legal advice against this lady.
**get a lock and place a NO TRESPASSING sign on your yard.
**make a police report against these people for trespassing onto your property.
**inform your neighbor, that should she allow her young son into your property, that you will seek trespassing and breaking and entering against her and will sue her.
I am quite sure this will cure her of any further ideas or notions she may have.
if it was my dogs, I wouldn't even consider letting the anyone keep my dog, or even entertain the thought of these people doing this to me. but then again, I don't think this lady would like her son left alone with a 100 lb rottie.... do you>?
(although he is a big baby, I'm not telling her that. and if she thought that was a good idea, then she needs to have her head examined!!)

You know what? This is just the beginning with this neighbor of yours...sounds like a troublemaker, to me.
Anybody who'd make you put your dog in a shelter for DEFENDING ITS TERRITORY is a stupid moron.
Visit your poor dog daily...can you imagine how confused and scared she is?
Also- a word of warning- ALWAYS watch these shelters- they don't hire geniuses and mistakes are made- make sure they UNDERSTAND YOUR DOG IS COMING HOME otherwise your dog might 'accidentally' get euthanised.
Make a pest of yourself (in a good way) at the shelter- volunteer your time helping out or something- but don't leave your dog alone the whole time.

I would not just wait out the 10 days- your dog will be frightened and scared and will not behave "normally". Call your vet and get them on your side.
If your dog has up to date rabies vaccines, you may be able to do a home visit instead.

Depends on what your state regulations are. In PA, you can either let the shelter quarantine, or pay an approved boarding kennel or vet to quarantine. As far as who will ultimately pay, it also depends on your state laws. I'd consult a lawyer so your rights don't get trampled. I firmly believe in the sanctitiy of personal property. If you're on MY land uninvited, you are a trespasser. As a trespasser, you give up your rights. Unfortunately, I'm not a lawmaker.

I would just take a deep breath and be patient for the 10 days. You can do it! I know you won't like it but it will all work out in the end. Also, if things don't work out totally the way you want. You could always get a lawyer (lol)!

Well i say get ur DOG back cuz its not ur falt or the dogs its the lil kids falt and do u have sings saying private property cuz then u can sue for them entering ur yard with out asking and did u put it in da shelter or did the other people but no mater what get ur dog back cuz u probly paid a lot of money for it and get ur dog back befor some one buys it

That seems a little extreme for barking... Do you have rabies shots?? I am surprised a new neighbour on the street would move in and start making such a fuss.. she won't endear herself to people if she starts out this way.. Seems like something is missing from your story?!?
