Am i worrying about nothing....

i had a car accident today, the side of my car was hit by a driver pulling out of a side street and they said they didn't see me.

1) It seems as though she will accept liability (i don't see how she could refuse liablity as only the side of my car and her front of hers is damaged and i sure as hell didn't slide the side of my car into the front of hers, lol!). Is there anyway she could try to blame me?

2) my insurance is up for renewal in the next 3 weeks, as this is not my fault (however it is not yet set in stone) and if they do accept liability is my insurance going to be affected in anyway, making it more costly?

please help... i am really worried (i'm a natural born worrier)!!!

ps...

i had pulled out from another side road on the opposite side to where the other driver was (but 10yrds further down the road) there was a car travlling up the road that she had to wait to pass her - but it had already passed me therefore i joined the main road (i hadn't even built up my speed to the speed limit - therefore not speeding) they assumed that it was safe to go when the car they were waiting for had passed rather than checking again (which if they did they would have seen moi!).

Did you have any witnesses .. this happened to me.. their fault ..so your insurance wont be affected,, their insurance also paid for a hired car for me until i got another car,, DONT WORRY

It's good that you are asking for opinions. I think that's good so you can hear the different perspectives and arguements from different individuals who have either experienced a similiar accident or have evaluated them as I did for 6 years.
I know the arguments and what others perceive occured based on their observations. I think I can help with some of those. The arguments is, who had the greater duty of lookout and who's responsibility it is to yield the right of way to the other. Did you have any liability or "look out" from your position as you entered the roadway? Or, did you "contribute" to the accident? Most of the time, the person entering the roadway and strikes another vehicle is at fault. My concern is that you had entered the roadway only 10 yards before the other vehicle. This is a very short distance and will be questioned by the other claims rep.

Were you completely in the roadway at the time of the accident?
Where is the damage on your vehicle?
Did the other driver pull onto the roadway as you were completing your turn onto the roadway?
Were there any witnesses that can help state to both insurance companies the facts of the loss?

If the other insurance company is "stalling" or calling you back to get more information, you can bet that there may be issues with liability.

From what you stated, it appears that the other party is "mostly" at fault. The question will be is if there is any liability on your part. Let the insurance companies fight this one. Make sure to know the facts inside and out. If you have already spoken to the other person's insurance company, don't do it anymore unless they accept full responsibility.

I'm sorry if this worries you, but it's just my honest observation.

dont worry yourself hun and dont listen to the people who tell you any different, you do get people on here that say thing just because they dont know the right answer, not funny in your case, anyway... you had already commited therefor you had the right of way and like it has already been stated above, once the insurers get all info regarding whos car had what damage and where....it will be obvious to both companies that because the damage to your car was on the side the other person hasnt a leg to stand on, even if they do not accept liability, she could say it was your fault but she would be pretty thick if she did, dont worry hun, all will be cool. Look on the face of things it is not your fault. She drove into you, not the other way round.
Your insurance will be affected until the claim is settled or liability is fully admitted so you will almost certainly have to pay an increased premium (subject to no claims insurance) until the matter is settled and then you should get a refund, It is best to check with you r insurance Company. It depends on how fast the matter is settled.

Well, she doesn't get the OPTION to accept liability, her insurance company is going to make that call. So sure, she can try to blame you. Depending on your state laws (because it varies!) you could be found partially at fault, or not at all. YOUR AGENT is the person who can give you state specific information.

If their insurance company accepts fault, it shouldn't affect your insurance at all. Actually, if you don't have the renewal quote yet, you will any second - so even if it DOES (and it shouldn't, but go back to your agent and ask), it won't hit until NEXT year.

Firstly you need to contact your insurance company so they can make a claim on your behalf to repair the damage to your car and I'm sure you will have nothing to worry about. Did you take her name, address and insurance company details and pass this to your insurers? By the way your insurance won't be affected if it's not your fault. Don't worry it will be fine! Don't listen to Tonalc1. I've had people crash into me and I've never had my insurance go up or heard of it. It will only affect the insurance of the other person.

Has she formally accepted liability ? if so you should have no problems in the end it is the insurance firms job to sort out any claims that is part of what you pay them for if it is found not to be your fault you will be OK as the other persons insurance pays for the repair to your car and should pay you for any out of pocket expenses you incur while awaiting the matter to be resolved keep any receipts you get for calls, postage etc etc and the claim should be resolved in a reasonable amount of time sounds like you should be fine best of luck

Your policy will not be affected until the accident has been investigated .

As you were travelling on the main road and the driver came out of a junction there is absolutely no way you might be held responsible regardless of what the other driver says .

Your insurance is fine or should be. If she can prove you were going too fast she could get u. How much damage done?

Sounds like its her fault, u can't have been speeding by the sounds of it, and she should have seen u pull out. Therefore she could have averted collision. Hope all goes well.

If they were pulling into the street that you were already on, clearly it is their fault. And I cannot think of any situation where the side of your car and the front of their car can be damaged, and it not be their fault lol.

Stop worrying, make yourself a nice cup of hot chocoate and to bed!

if u were on the main road and she pulled out of a side road then it is her fault. dont worry too much insurance should sort it out just tell the truth.
