In a no-fault state, you're supposed to turn it all over to your insurance company, which is supposed to go after the the other party's insurance if he was at fault. If there was a police report and pictures of the accident, it should be pretty clear who is at fault.

There is usually a threshold for damages (like pain and suffering) or to sue the other side and his insurance company, which may be why the lawyer said to get an MRI. A year is not too long, but you should not have waited all this time. If that lawyer is not helping, get another one. And don't wait another year.

Why wait a year to ask what to do, when anyone with a 1/2 way decent education in auto driving laws would know what to do.

Why call a lawyer when you are in a no fault state.

This is what you have auto insurance for.
You in an accident, car damaged, medical expenses, you hurting, you miss work, lose income, have to use other transportation.

You should have called your insurance company within a few days of the accident. They would have paid for the car, your medical expenses reimbursed, the money you lost from being out of work.

There is probably a statute of limitations, and you may have missed it.

So now you have had an expensive education that you should have had a long time ago, when the education would not have caused you to throw away your car and other things.

On the day it happens, or as soon as possible you report it to your insurance carrier. You get a copy of the police report and make sure they see that. They handle it for you.

If you didn't do that, and almost a year has gone by, I don't know what to tell you except contact them now and ask for help, they may or may not do something for you after waiting this long.
