If a man never signs the birth certificate then NO he does not have any rights to the child in any way, shape, or form. You also cannot ask for any type of child support either though. In order to establish paternity, a paternity test has to be done through your friend of the court building. If the father knows he is the dad without having to take a paternity test then you can get a document and have him and you sign it in front of a notary person and then he will be placed on the birth certificate and have legal parental rights. Till then you have sole responsibility and custody of the child.

I dont think the dad signs the birth certificate. The mom does that in the hospital. If his name is on it I would say yes. I would say if there is a doubt is the father then have a DNA test taken. If he isn't the father then he has no rights legally. Morally perhaps if he has been in the childs life and said child is attached , vice versa. Seek an attorney to be sure. Good Luck!

Yes, but paternity needs to be established first and that could take a while. If you are not sure that you are the father i would highly recomend getting a dna test. If you sign the birth certificate, the baby is YOURS whether he really is or isn't.

I agree one hundred% with what you informed him.. at present ask for an emergency order to teach paternity AND pending further action on the subject of explanation as to his custody rights. each and every state has distinctive rules on the subject of single father's rights, which must be heard by utilising a court. Her criminal status could have a bearing, yet additionally the reality that he's the father, and intends to make sparkling his very own criminal status as father. lots relies upon on how previous toddler is, and the place toddler has lived because beginning. He needs to act with out postpone... i can not rigidity that sufficient.

I didn't think either parent signed the birth certificate. if his name is on it (put there by the hospital), he should have some visitation rights. if he's paying child support and is interested, he should get some rights. if he's not paying, he should have fewer rights. just do what's in the best interests of the child, not what you want for yourself. kids should know their fathers.

If both parents agree that he is the father, and they aren't married (it is assumed the husband is the biological father) yes. The right way is to prove paternity, and go through the court system.

He would have to take you and prove that it is his child. This would put his name on the birth certificate. He must also know that along with this comes childsuport. lol. Good luck.
