If your husband is abusive -- abuse is not just being physically beaten -- you could possibly make a petition for yourself under the Violence Against Women Act ("VAWA"). This is the first step (out of two steps) to becoming a permanent resident this way. If your husband uses your status to control you, if he is intentionally isolating you from your family, then he is being abusive. Why does he want you to be illegal? Ask yourself that. If he's doing it as a means to control you better, then it's abuse. Abuse comes in many forms -- physical, emotional, mental, spiritual, economic, sexual, etc. This VAWA self-petition is more than something someone can do without an attorney. You have to put together documentation to show that: 1) you entered into the marriage for the right reasons (not just to get residency), 2) you lived together, 3) you are a person of good moral character, 4) he is a US citizen and you are married and 5) that you have suffered abuse. A good first step would be to find a women's shelter and get counseling. They often can connect you with low-cost or free immigration attorneys to help you with the VAWA case. You need a lawyer, or at least an accredited representative.

This law was passed years ago to protect people like you. A self-petition under VAWA is completely confidential. No one will ever contact your husband to ask him if what you've said is true, because that could put you in danger. Immigration officials are subject to serious sanctions if they contact the abuser in these cases.
