I sent a check to for the high school reunion. Somehow the check got misplaced. Mine wasn't the only one misplaced. Contacted my bank they charge to stop a payment on the check. If I pay the fee this ads onto the price I already paid to attend the reunion. Do you think I should still be libel for the payment? I don't know what calif. law states but I think I shouldn't have to reissue another check. I'm wondering if I should even stop payment. Please give me some advice.

found out about the check missing when i attended the reunion. Was still allowed to attend. I was informed from the head person in charge he did get the check but it's been misplaced & that is why my name wasn't checked off. I feel It's his mistake.

well, sure it's his mistake!

But are you liable for a service you're asking your bank to render? ABSOLUTELY. If YOU request YOUR BANK to perform a service on your behalf, YOU are liablt to your bank for the FEE for that service.

You want to try to recover that fee from this guy that lost the check? Feel free. It will likely end up costing you A LOT more than the actual fee itself, regardless of whether or not you recover.

lost checks are an ordinary occurance.

if you don't send in a replacement check, you can't expect to be welcome since you won't have paid.

I never bother with the stop payment for lost checks, I just write another and send a letter with it naming it a duplicate to replace the lost item. If the first one later turns up, it can't be cashed by anyone other than the person or organization it is made out to anyway and they already know it was lost and should be returned or shredded.

so if both do get cashed, either one was forged or i'm sending money to, at best, a careless outfit [or at worst, thieves].

I usually figure thieves aren't very likely since I don't write checks for poor reasons.
