Check the bridge, I had the same problem with one of my guitars. I figured out the bridge was too high. I had to unstring it and take a hammer to it to drop it down about a cm or so.

There are two problems I can think of that will cause this:

1. The neck is warped. You say it looks OK, but if the action is just a bit high (check around fret 12, that's where it will be worst), it can throw the intonation of the upper frets way off.

2. The guitar is just constructed badly. If the bridge is not properly positioned, the strings will sound fine when tuned open, but will not change pitch correctly when fretted. The distance from the nut to the 12th fret should be the same as the distance from the 12th fret to the bridge.

This is much less likely.

I would say wrong strings........guitar is warped........(check again) Or strings are too high from the frets
